LPG tank regulations change

We have had our underground LPG tank for 24 years, originally installed by Shell Gas who were taken over by Avanti Gas. It is buried in our front garden with a small retaining wall which we were advised to build to prevent the earth collapsing! We have received an email advising that our tank is no longer compliant and we need to lower the level of our garden 1 metre around the tank so it is level with the turret of the tank! After speaking to Avanti Gas I asked if they are contacting all their customers with old tanks who no longer meet the current requirements and the guy I spoke to said he currently has 800+ disgruntled customers he is dealing with! Surely if the tank was installed before the regulations it is exempt? Any advice would be appreciated.
