And thats more than they have to do. Some stores will not even offer a credit note at a reduced value.

OK, so on this basis a company could decide to opt a no refund policy unless the goods are deemed to be faulty, as this would not contravene consumer rights?

    Absoutely correct.

Why not ask the donor of the brand new one you've received if that one can be returned?

Or sell either of them for the best price you can get, if it's more than CEX will give you for the one you don't want any more.  Or see what CEX will give you for the brand new one.

The person that gifted the new ATV to me received it as a prize a while back so returning it is not an option, from all the responses received will just chalk this up to a bad experience and give CEX a wide berth in the future.

Why give them a wide berth when they did nothing wrong? You were happy with the purchase at the time.

    Toys out pram methinks.
OK, If that's what you think no problem, but I do think this is unreasonable and a good way of losing customers, as previously stated I don't know if any other high street store that has a 2 day return window!!!

Why don't you just keep the first Apple TV and sell the second one?  Is the latter still obviously new, e.g. shrink-wrapped?  I'm sure CEX would give you a price for it.

TBH, I do think you're cutting off your nose to spite your face - you're upset that CEX legally have done more than they have to, but less than you would like them to do.

You could sell the brand new one?

It's not a bad experience.  You bought something at a price you were happy with, you were gifted a newer version and you've been offered something back on what you bought.  However you do the maths, you're "up" on the deal.  You've either got two of something you wanted, or you've got what you wanted and can get some cash back.  Where's the "bad experience"?

OK, let's close this down now as this is getting rather dull to say the least and it seems that everyone has an opinion and it seems that there are many CEX fans out there who think that their store practices are more than reasonable so good to know!!! But I won't be buying from them again!

I suppose that difference between a good experience and bad experience is when you compare similar situations and outcomes and in my view this is a bad experience. I'm now going to gift this on to someone else who thoroughly deserves it and let that be the end to it!!!
