Private land carparking ticket Flamborough Head Yorkshire

HI please help I have received a final warning car park ticket, i have never received any other documentation and this was from Feb 24. It was for my mum who's 90 and disabled. She had parked up got out the car taking time due to disability and getting her walker over to the machine - unfortunately she didn't have the right money and the other means of paying is by an app. Mum as no internet on her phone. so after a while returned back to car got in and drove out car park she was there about 30 mins. can anyone suggest what we do as mum is really worried as the paperwork says they may take her to court. thanks

    Are you the registered keeper. ?  Or is mum the Registered keeper. ?

    Post a redacted picture of both sides of the original NTK PCN letter received in February or March, redacting the name and address, the VRM details and also redact the PCN reference number 

    Leave all the dates and times showing 

    If possible post pictures of the signs on site too

    30 minutes without paying is a long time to argue over, typically you get 5 or 10 minutes

    But they have to take in account any disability ( has your mum got a blue badge - is she registered as disabled ) if so she can argue under the equality act.

    If its private property then the blue badge is just an indicator of disabilities, the Equality Act 2010 talks about reasonable adjustments but a BB holder is still expected to pay or leave promptly, it doesn't usually grant free parking, I suggest that both of you study the blue booklet that came with the badge, plus read sections of the Equality Act 210 as well

    Reasonable adjustment might mean doubling the consideration period on entry, but difficult to talk about half an hour on site without paying 

    The signs are what convey the contract, but you have not shown us pictures of the signage or pictures of the PCN or reminder, we don't even know who sent the letter 

    We require a lot more information before any proper advice can be given

    This is what was sent the only document. Mum as received and she was the driver if the vehicle.  Its that we have only just got notice as up the road they have a very simular address and some if our mail must go there thanks

    So either a debt collector letter or possibly a letter of claim, not the PCN itself 

    There must be a reason as to why no previous paperwork arrived, such as moving house etc , not updating the V5c meaning that the letters went to an old address , so check that the V5c has the correct address on it, ASAP

    Who is the registered keeper ? You or your mum. ? Or someone else. ?

    What is the name of the parking company listed on the dcbl letter. ?

    You are not giving us the information asked for, not yet anyway , please answer ALL the questions so far 
  • This is the only letter received , no idea why mum as not received any others, mums name and address was on the paperwork which I've taken off, mum is the registered keeper, the client is Britannia Parking Group Ltd, all paperwork is up to date address etc thanks

    The original letters sent out by Britannia went somewhere, but as long as the V5c and current address are correct then no problem with basic details, just that this debt collectors letter is the first letter actually received by your mum, but there should have been previous letters, at least two letters from Britannia 

    Go to the newbies FAQ sticky thread in announcements at the top of the forum, about 6 threads down, so above your thread, read the 4th post about debt collectors letters, in that thread by coupon mad , debt collectors are powerless, so no need to worry at the moment 

    It would be a good idea to try to find out who the landowner is, ASAP

    Well if it is here there don't seem to be any signs to create a contract for anything, no wonder they might be reluctant to send anything to get challenged on!
