Are you saying that the court knew your unavailable dates yet arranged an in-person hearing during that time?  Complain, quickly:

They are more than likely to pay the trial fee, and at £59 (is that a typo for £50?) suggests more than one PCN and a claim of between £300 - £500, making this going forward more likely than not.  PCM are generally litigious. Keep on track with this.

I have sent an email to the court stating that they have overlooked the N18 document and unavailable dates. I’ll await their response.

£59 is the correct fee. London court, presume fee is inflated.

Is there anything else I need to prepare before the court hearing? I have followed the newbies thread up until now.

    It's actually the hearing fee. The filing fee is £50 (for £300 - £500) with a hearing fee of £59 (for £300 - £500).

Follow the email up this week with a phone call and insist the date error is rectified at zero cost.

    Response from email:

“Upon considering the email of the Defendant dated 28 October 2024 , the Court directs:

    1. The Defendant must comply with the requirements of Civil Procedure Rule 38.9  re: copying the Claimant into correspondence with the Court
    2. The claim requires determination before 2026 so either:

    (i)                  The Defendant does not attend and relies on written evidence and documents and sends notice in accordance with Civil Procedure Rule 27.9 by the time specified in that rule to  the Court and to the Claimant or

(ii)                Makes an application on form N244 (and pays the appropriate fee or applies for remission) seeking permission to join the hearing by video link albeit her attention is drawn to Civil Procedure Rules Practice Direction 32, Annex 3 paragraph 4 and the requirement for the court to be satisfied there is no objection from the foreign government to a party giving evidence in English proceedings from abroad.”

    Any advice?

Reply and object and escalate it as a formal complaint. Tell the court you require a response from the Court Manager. Attach a copy of the N180 where you stated the date was not available. This is court error.

Hi all - Looking for some help. I followed the steps and escalated to the court as a formal complaint. Attached a copy of the N180 form stating the I am unavailable for the date suggested. As im not in the country the judgement went ahead.

I have just received a General Form of Judgement or Order where I have been adjudged to pay the claimant a sum of money.

I received the letter today, and the request was that payment should have been made before the end of December 2024.

What options do I have left? Really struggling here being out of the country. Would appreciate any help. Thank you
