POPLA (Parking on Private Land Appeals) Fine

Received a £100 fine for parking in a car park that I usually use during the day.  Normally it is free to park by the shops.  However, this time I was early to the shops (07:00) and I received a parking fine because they don't allow people to park overnight.  I have appealed but no joy.  Have heard that you shouldn't feel obliged to pay POPLA fines especially when they are excessive and I thing £100 for parking 20 minutes is excessive.  Would appreciate forum advise.

    It is not a fine!!!!   Have you read the Newbies thread?  Please do this before asking questions that will be answered on there and then the very helpful experts here will advise you.
    Never pay anything to these **** people, never reply to debt collectors,  Never say who was driving.

    POPLA dont issue fines or penalties, they adjudicate BPA AOS members parking charges when an appeal is received 

    Name the parking company and general location of the charge etc 

    The excessive aspect has not been valid for a long time, several years in fact

    Not appealing or paying a parking charge notice could lead to a civil court claim within 6 years

    So if you were there waiting for a shop to open, and you obviously didn't park over night have you complained to the landowner that their parking company idiots have sent you one of their silly invoices?
    Don't rush into an appeal to POPLA stating what happened on the day they will reject it come here first and let the regulars see what you are saying first.
    We need to know  the PPC and the location may have come up before, also what the signage says etc.

  • Thanks folks for the comments.  Here is the parking sign.  They recorded me entering at 6:50 and leaving at 7:20.  The parking area is Queensmead, Farnborough.  PS - Appreciate all the help.  Have heard that you shouldn't treat these parking notices in the same way as local govt charges but just need help as a £100 fine is worrying

    UKPC issued the PCN, the maximum stay is 3 hours, no contract is offered in the out of hours period 

    Its not a fine, its a private parking charge notice from UKPC, nothing like council PCNs, but UKPC can issue a private PCN and eventually it could go to civil court, one near you, so do not ignore it 

    Your best option is to complain to the retail park management team ASAP and get the PCN cancelled

    No they did not.

    They may well have a record of your vehicle entering and leaving the car park at those times but they have absolutely no idea who was driving at the time. 

    Keep it that way.

    You haven't got a fine.  Please stop calling it a fine.  The retail park managers can cancel this immediately.  Very easy.  As the NEWBIES FAQS thread already tells everyone.

  • I was driving home on 1.1.2024
    The weather was terrible with storms and torrential rain. Without any warning my driver side wiper blade became detached and flew off. Luckily I was approaching a motorway service station. I pulled into the station to see if I could get a replacement blade but they didn't have any. This took a total of ten minutes. I got back to my car and drove down to the fuel station which wasn't near the main services but a drive down the road that leads back to the motorway. Unfortunately they also didn't have one so I parked up away from the pumps and tried to remove the passenger side blade to use as a temporary get me home fix. Unfortunately I could not remove it as it was fixed and I didn't have the tools needed on me.
    I had no option but to call the RAC rescue. They took over two hours to attend which took me over the two hours maximum stay.. I have the RAC report to confirm this. They fixed the problem and I left the site after spending 3hrs and 43 minutes there. 
    Eight days later I received a letter from a parking company demanding that I pay them £60
    for the overstay. I refused to pay because of what I thought were mitigating circumstances but another demand upped to £100 arrived on the 26-02-24.
    I ignored this and on the 9-04-24 I got a letter from Bailiffs demanding £170 and making threats if I didn't pay. 
    On the 24-04-24 they sent me another threatening letter saying its a final reminder for £170
    I am determined not to give in on this because I believe I had no option as it would have been dangerous and illegal to drive my car. 
    I recently returned to the service station to get photo and video evidence to support my case. On entering the site I noticed that the entry notice board with all the t and c's on was side ways on and being obscured by another sign for a vehicle finance firm. Cars were driving  past it without stopping to read it. I parked in the car park and took some pictures of the signs some of which were old and illegable. 
    I drove on down to the fuel station and noticed there were no signs there at all and no marked out parking bays. So how can that be a part of the car park. I have photo and video evidence to support this.
    Sorry for long post. Hope you can advise what to do next.
