Whatever, that contract term that the deposit will just be kept unless under certain circumstances which are not revealed before the contract is formed and will be decided at the company's absolute discretion sounds to me to be the very model of an unfair contract term.
Thanks for posting.  I did not have the option to order without a deposit.  I imagine the deposit both gives them some justification to work with the manufacturer and also to hold a place in the queue - both of these I understand and there has to be give and take on both sides.  However, when this can go on for approaching two years it feels like it is definitely becoming "unfair" and I was interested to see that Forumites had to say.

If I decide to make further representations to the vendor I might just steal your wording "sounds to me to be the very model of an unfair contract term"!  Thanks again.

One thing to bear in mind is that some items have a long and variable waiting time, especially if made by hand.

The classic example of this is a Morgan car which has varied between six months and more than ten years. I was watching a YouTube video about a turntable that took seven years.

So it's going to come down to what the ting you've ordered is and how it's made.
