Enhanced Redundancy payments - Age discrimination

Hello..
First post here so I hope I don't break any rules :-)
My entire Service Desk have been put on Consultation & are two weeks in to the process.
Of he 12 of us 1 is entitled to nothing as only started in December.
The rest are all in the age bracket ro receive 1 weeks statutory pay except for myself & one other who are over 41 so receive 1.5 weeks
My compay have today advised that they will pay an enhanced rate of 1.5 to all those who are entitled to redundancy, but as me & the other chap are already on 1.5 we get nothing extra.
Is this legal? Age discrimination, we are both over 60? Or just dirty & unethical by the company?

I cant comment on the legality but I dont think a company who are dirty and unethical would be enhancing the rate for the others.1

well, you haven't lost anything - so I doubt you could argue you are being discriminated against.
dirty & unethical? probably not - seems the company are looking to provide a equal payment to everyone.
They could probably do anything they like over and above the statutory amount.0 -

Check they aren't paying statutory on top. Sometimes they do, I got statutory on top when I was made redundant.0

You are not bothered about the age discrimination against those under 41 who would have originally received only 1 weeks pay then?
We could make an argument to say that your employer is trying to treat everyone the same to reverse the built in age discrimination or can we ignore it when it goes in your favour?2 -

Sounds like they are actually proactively avoiding age discrimination.
They are ensuring everyone gets the same multiple irrespective of age.1 -
