    Who knows, without trying.

It would certainly be foolish, not to mention expensive, not to try.

It would also be a little rash to cancel the policy without realising the almost certain outcome of doing so, as per Tesco's policy:

"We will not give any proof of Your No Claim Discount unless You have paid all the premiums You owe."

It could be quite a bit more expensive to have Tesco obtain judgement on the debt, and to have no NCD applicable to a new policy.
  • Also from experience you will find it very difficult to find a cheaper policy for a young driver

The fact is the difference is because tesco's system knows fine that a non spouse is likely a friend or child and in turn know fine your just trying to get round the expensive premiums

Accept it, pay up and move on, otherwise the battle will be costly, additionally if they in turn register a fraud note or refusal you will have a nightmare getting insured again

I am with tesco, its not an easy mistake to make and its entirely your own fault and tbh if your son did it it wouldnt surprise me if he did have fraudulent motives

    i agree

i don't want to cast accusations, but the fact that you decided not to insure and cancel the policy with the correct details for your son because it was too expensive, but were happy to insure him when the details (and risk) were mis-represented makes you look fraudulant.

I think you are looking to blame tesco when the answer unfortunately is much closer to home. its your responsibility to provide accurate information and check the policy documents when you receive them.

If you took out the policy, you may have made a genuine mistake.

If your son took out the policy its time for some tough questions to be asked about how honestly he filled it in (did he know you would refuse to insure him at £1400 but would accept the £700).
  • Thank you everybody for the answers!

Looks like my best bid would be to call and try to lover 1400 down since bright new polici will cost around 1500 so don’t understand why they are trying to get 1400+700(original). At least it would be around 800 extra.

I’ve checked Certificate and Motor Insurance Schedule and it doesn’t say ANYWHERE about the spouse. I think it will be the first point on my conversation.

Thanks everybody for your fast reply! It really helps! Will let you know how it will end!

p.s. I filled the forms myself. As I sad he doesn’t care about this car any way. I’ve only done it for emergency and long distance journeys. And he didn’t even drive the car. He is 24y.o.

The relation of the named driver to the policyholder may well not be stated on those documents. However, it should be stated on either a Statement of Motor Insurance or a Proposal Form. If Tesco use a Proposal Form, you will have signed it and sent it back to Tesco and so won't have a copy unless you photocopied it at the time.

I guess the message is that those prone to making errors should change insurance company each year!

    Well there you go.

You are responsible for checking the policy documents when you receive them.

You have done so. It correctly lists the names and details of the insured.

They haven't got a leg to stand on, it is just their word, that a very material fact, that doubles the premium, is one thing, and you think it is another.

The policy is the contract, it should be on there. A judge would throw it out, they could never rely on that in court.

In this case they should void your insurance with notice, and tell you to find a new insurer as there has been an error.

p.s. I filled the forms myself. As I sad he doesn’t care about this car any way. I’ve only done it for emergency and long distance journeys. And he didn’t even drive the car. He is 24y.o.

In which case I think the premium is very high.

I am 25 now, but my first insurance was when I was 22, and it was £700 with no NCD, newly-qualified principal driver, no other driver named (naming an older safer driver or a woman substantially reduces the premium). I don't know about your car, but mine was a 1.6 litre small family hatchback, not a high risk car.

The insurance should get much cheaper when he reaches 25, it is worth comparing quotes, for a 24 and a 25 year old, it will probably be cheaper to use taxis then.

What about the input from the online quotation that the OP did himself?

    Doesn't sound like he did:

"It was online application and after I had to call because online didn't work but I don’t remember if I had to give details once more so it could be anybody’s fault."

Firstly, it's unclear whether or not the details actually were communicated over the phone. If they were, then it would be the phone op's fault for wrongly transcribing it.

But secondly, if you take out insurance online you would be given the opportunity to review the details before purchasing, and he was denied that opportunity, and it wasn't on the policy document either.

Seems like far too many failings on Tesco's part to me for them to claim hundreds of pounds based on something he never saw.

Seems like it may or may not have been OP at fault. I suggest OP asks Tesco for written evidence of his "error". One could argue that Tesco have a duty of care and ought to have questioned a spouse named "Trevor" 20 years his junior.
