    Hello my company is trying to charge me £4000 for damage to a company van, the van in question was given to me 2nd hand,
    no hand over paperwork to state what damage the van had when I received it or anything.

     The van was handed back a few months back and now they are trying to bill me. I didn't create the damage but can't prove it but nor can the company.

    The insurance excess is £500 but they are saying because it's gone back to the lease company I'm liable to pay for the full damage cost. 

    My contract says- 
    Where you are found to be responsible for any damage to a Company vehicle, You will be liable for the payment to the company of the cost of any insurance excess fees arising as a consequence of any accident or damage to Company vehicle
     Failure to adhere to these clauses will be dealt with under the disciplinary procedure and in serious cases will be classed as gross misconduct under the disciplinary procedure.

    Any advice would be greatly received 
    Ask your employer for proof of the van's condition on the day it was handed over to your care.  It is only reasonable that they prove their claim.  And in future, when you receive a vehicle photograph it from every angle!  We always do so with hire cars to avoid just such an issue.

    It's an employment contract issue and not a motoring one

    How long was the lease? I guess if the van is 5+ years old and you had it for 6 months, the damage was likely done previously.
    No one would know if we damaged works vehicles, unless another vehicle was involved.
