Damage to a company van

Hello my company is trying to charge me £4000 for damage to a company van, the van in question was given to me 2nd hand,
no hand over paperwork to state what damage the van had when I received it or anything.

 The van was handed back a few months back and now they are trying to bill me. I didn't create the damage but can't prove it but nor can the company.

The insurance excess is £500 but they are saying because it's gone back to the lease company I'm liable to pay for the full damage cost. 

My contract says- 
Where you are found to be responsible for any damage to a Company vehicle, You will be liable for the payment to the company of the cost of any insurance excess fees arising as a consequence of any accident or damage to Company vehicle
 Failure to adhere to these clauses will be dealt with under the disciplinary procedure and in serious cases will be classed as gross misconduct under the disciplinary procedure.

Any advice would be greatly received

    Use the emails you sent and photographs you took when you were handed over a damaged van. That will sort things out quickly - you did raise the issue didn't you?

    Yeah I still work for them. I swapped vans due to other reasons not related to the damage

    So what are you claiming? They gave you a damaged van and you did no further damage or they gave you a clean vehicle, you returned a clean vehicle and the damage was done post handback?

    They gave me a damaged van, I handed it back the same apart from 1 mark I done myself.

    Did you take any photos of the van when you got it, before you'd driven it to show the damage at that point?

    The OP said "I didn't create the damage but can't prove it but nor can the company." so I'm guessing the answer to your question is no.

    Do you have access to legal advice, e.g. through a union or legal cover as an add-on to an insurance policy?  If so, I would contact them.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
