Another Bristol airport -"stopping in a zone where stopping is prohibited" - VCS

Hi all, I've just received a CN /NTK from VCS at Bristol Airport.
The vehicle in question was travelling to the airport to be dropped off and a parking company to pick up and park off site. Last time used the same company, the drop off was by the airport entrance, but the instructions for where to go didn't say the same name as this carpark, so the signs were followed at the airport for the name of the carpark on the instructions. When the direction to said instructed carpark was different it caused confusion as it wasn't the expected direction to go, tried to make contact with off site car parking company, once arrived at carpark barrier, car was uturned as confused by is this the correct location, came back up to the junction to roundabout trying to determine what to do, was 'parked' at roundabout 1min 2 seconds according to their 'evidence' (photos from cctv), hence charge notice. Carpark firm confirmed this was correct carpark on the phone, went around roundabout and into carpark and paid parking charge £6 for 10 minutes!! 
The car was at a junction to a roundabout at no time was it parked up, no one left or entered the vehicle, no one was dropped off or picked up and the actual carpark was used and paid for correctly.
As the keeper of the vehicle I am so annoyed and frankly disgusted at this blatant rip off cowboy company and what they are doing!!
What are your thoughts!!

    Thoughts? Have you read the Newbies/FAQ thread? Just don't reveal the identity of the driver. The NtK is addressed to the keeper because VCS don't know the identity of the driver. Only the driver can be liable. VCS cannot transfer liability from the driver to the keeper because they cannot use PoFA to do so. They can't use PoFA because airport land is under statutory control.

    Now, read the Newbies/FAQ thread to understand what you must now do.

    Plan A is for the registered keeper to: -

    Complain to the landowner majority shareholder, a Canadian investment company. Don't expect them to reply at all.
    Complain to the sub-contractor, Bristol Airport Limited, that operates the airport on behalf of the landowners. Don't expect them to be on the side of the motorist.
    Complain to the keeper's MP.

    Plan B is for the keeper to appeal to VCS using the template in blue text from the sticky Announcement for NEWBIES, and add a one liner that the site is not relevant land as defined by the PoFA 2012, the site is covered by airport byelaws, the keeper cannot be held liable, stopping is not parking, stopping at a roundabout is a mandatory requirement as defined by the airport byelaws.
    The appeal will be rejected.

    What you do next will depend upon the wording of the rejection. 
    It is important that you do not out miss any of the stages mentioned above.

    You won't be paying this under any circumstances but appeals are futile.  Complain to the Airport.

  • Hi all thanks for your comments info, I've sent in an appeal using the blue part from 'newbies' I also added a bit about not parking, not dropping off or picking up and no one left or entered the car, I also added that I would like evidence of signage at the site where it says that all drivers must ignore the highway code and not stop for junctions, roundabouts and crossroads which is essentially what they are saying I have done.
    My next steps are to send in complaints to my mp, the airport shareholders and bristol airport I believe!
    By the way, I also did not name the driver.

    Plan A, as its name suggests is first, complain to Bristol Airport.  I hope you didn't infer who was driving by adding bits to the template (blue) appeal text, which is designed to ensure you don't do that.

    Did you add the more important points about it being not relevant land where byelaws apply and therefore the keeper cannot be held liable?
