  • I basically didn't know what it meant and was worried it was to do with something not relevant to my case, as I have removed quite a bit of stuff to this effect I guess I had it in my head.

    I have had my N180 in the post, filled out the digital version with help from the threads here and sent is by email to the County Court and Claimant (as requested on the cover letter) - but not to the CNBC as suggested in the Newbies thread as this is not noted on the cover letter, I assume this is the right approach. 

    fingers crossed SiP don't turn up to the mandatory mediation and it gets struck out.

    I did have one Q - should this email also be titled the same way? "Urgent... N180 of defendant..."?

    I haven't re-read your thread but if the CNBC currently have no involvement in this case then they don't need or want to see a completed DQ.

    So, an update.

    In the time between my last post and now I have had no firther information from the court, and the only correspondence from SIP is a 'Directions Questionnaire'.

    I have just received a letter from the court saying it has been allocated to a paper hearing. From reading on the forums it seems that the advice is to object to this. I just wanted to confirm this is the right approach? This document also requests that I send in a Witness Statement for the paper hearing... is this just the same Witness Statement I have already submitted as ordered from my previous trial?

    You should object to a paper hearing in the covering email when you send in your new WS and evidence.

    No it isn't the same WS as your CCJ one.

    Did you inadvertently tick the "suitable for determination without a hearing" box when you completed the N180?

    It looks like I mistakenly didn't select either - but I did fill out the box below the selection with the suggested text saying I that I am not content with a paper hearing:

    Attach that to your email that attaches your WS and remind the court that you clearly objected to a hearing on the papers and you want a hearing, please.  Add any new Spring/Summer 'unavailable' dates to the covering email of course (sods' law).
