They state that the owner is nthe person who keeps the vehicle. Not always the case surelyYou never know how far you can go until you go too far.1

Did you ask APCOA that question?Umkomaas said:
Even if you paid APCOA, there's no way they'd be handing that over to the Exchequer. This is just a PCN dressed up as a byelaws penalty.CyrilFairweather said:
OK. So I found @troublemaker22 's response in another thread.. any funds from a claim under the byelaw go to the public purse and not APCOA hence there is no incentive for them to pursue. That's hilariousCyrilFairweather said:I have one final question. Apologies if it has been answered already.. The rejection letter says that APCOA may pursue for the amount outstanding + costs.
If they are able to claim for costs why would they not pursue this?
If you're up for a bit of mischief with them, write to say that you understand that byelaws penalty payments are routed to the Exchequer. Ask that should you pay APCOA, would they confirm that your payment will be lodged with the Exchequer. Love to read their reply. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Oh boy, apologies for adding to the deluge! Thanks for the link👍Umkomaas said:Please read NEWBIES FAQ Announcement, fourth post, all about dealing with debt crawlers.1 -
Morning all,
I've read the Newbies info and whilst it's not all relevant to this case I think I'm good to ignore this latest notice from Debt Recovery Plus, but it's certainly stressing me out. Particularly the last paragraph on page 2.
Can I just confirm that the advice is still current and this is ok to ignore?
Thanks

Hi GrizebeckGrizebeck said:why do people keep posting up these letters if they have read the newbies
Sorry for the extra noise.
The Newbies page was last updated in April so I'm just checking to make sure that nothing has changed.
Also, there does seem to be some conflicting advice i.e. "DON'T PAY BUT DON'T IGNORE IT (except N.Ireland)."
I have just ignored it.
It seems that the notice is out of time now but I don't know 100% if there might be circumstances under which the notice could still be pursued beyond 6 months.
Once again, apologies for the question. I'll let it run and see what happens!🤞0 -
The advice in the NEWBIES thread is up to date. It says "don't ignore a PCN" because in many cases they are easy to kill off by appeal.
The fourth post (for people already past that stage) then covers debt recovery letters which are ALWAYS to be ignored.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
