Capital Bank (Car finance commission mis-selling question)

Good afternoon.

I am trying to find relevant details for the Bank of Scotland (regarding Capital Bank PLC). I bought a Motorcycle in 2007 on HP and Capital Bank PLC were the then finance company that the dealership was using. After Martin's latest campaign, I wanted to contact them to see if I have been effected. Capital Bank was acquired by Bank of Scotland in 2007 and used to be based in Chester.

I have sent a letter with all the relevant details (I used the template provided) to Bank of Scotland to the address they advertise. The Mound in Edinburgh, but never got a reply despite it being signed for (Royal Mail tracked), this was almost 2 months ago.

I have called the bank but without a bank account number for the Bank of Scotland the call handlers will not help me at all. I have emailed them using the only address I could find - onlinecomplaints@bankofscotland.co.uk (found on the web) but again, radio silence.

I have found an alternative offices address in London, using Companies House website - Gresham Street, London but that is just the registered business address for the Directors of the bank and I suspect it will just be binned.

Can anyone advise me further how I can get in contact with them to look at this, so that I at least even get an acknowledgement of my request? As my attempts have been signed for I can at least prove they have my request, armed with that can I take it to the FCA for failure to respond?

Any advice greatly appreciated.

    When in 2007?   It is only from April 2007 that FCA covers it.  i.e. if you did it in January 2007 then you are out of scope.  The big issue for you is going to be data protection.

    As my attempts have been signed for I can at least prove they have my request, armed with that can I take it to the FCA for failure to respond?
    You cannot take it to the FCA.  The FCA are the regulator.  They don't handle consumer complaints.

    Its worth noting that the FCA has suspended complaints regarding DCA.   So, firms are not required to handle DCA complaints at the moment.  They can just stack them up until after September.

  • I took the HP out in March 2007. Are you saying that it is not worth pursuing a case for possible miss selling?

    Correct.    Yours predates April 2007 (date of application is what matters).

    The FSA, as it was then, only took over consumer credit jurisdiction from 6th April 2007.    Anything from before that predates FCA regulation.   And as this is an FCA issue, it wont apply to any finance that predates FCA regulation.

    Without wanting to appear pedantic, the FSA/FCA did not take over consumer credit jurisdiction until April 2014.  It was the FOS who were given responsibility over consumer credit complaints from April 2007, and therefore anything dated before then is outside of their scope.

    If the OP's agreement was March 2007 then it cannot be complained about, end of.

    No issue. You are right.    All these dates sometimes blur.    It was home finance that FCA took over on 6th April 2007 but FOS remit for consumer credit from that date as you confirm.
