Paid for ticket but used wrong car reg!

Hi everyone,

Such a great amount of info on here and thanks for taking the time to consider my query, which I can't see has come up before.

I went to the hospital and correctly paid for the parking using the APCOA app. However, as we use this regularly, it has my car and my wife's car on the app. Accidently clicked on the wifes car when I paid. Didn't notice and thought nothing more about it. Possibly this was the last car used, but not sure.

A few days later, we got a PCN. I replied saying - sorry, silly me, I did pay you, but used the wrong car. I sent the reciept and apologised for the inconvenience thinking that would be an end to it.

Wrong! APCOA told me that my challenge was rejected and that the PCN had been issued correctly and that I had to pay up - not at £130. I have pointed out that they have received the correct parking fee of £5 and that they have suffered no loss whatsoever because I paid to use the parking space. There has never een any substantive reply to this, but several chasers from ZZPS asking me to pay and now they have instructed QDR solicitors who have advised that if I dont pay in 14 days, they will issue court proceedings. 

I should also point out that the PCN was addressed to my wife, the owner of the car - but I have told them that I was the driver. (Now having read the newbie thread I maybe should not have done this). Anyway, there has never been a PCN addressed to me - just the various chasing payment letter.

Does anyone have any advice for me please? I think that they will struggle to show any loss so I am not sure that they would win at court, but anxious to avoid a CCJ in case I have slipped up.

    Did they not offer the mandatory £20 for a major keying error as set out in the BPA CoP?

    If not send APCOA a complaint (not appeal) telling them they breached the BPA CoP and quote the clause breached.  Tell them you will report them to the BPA.

    Hi Coupon Mad - no, I wasnt offered anything. They just told me that the challenge was rejected and pressed on with a higher claim. I am not sure what you mean about a £20 offer. Are you saying that it what I should have offered them? Thanks

    Got it, thanks. Do you think that I should offer / send them £20 now and tell them that I will draw this to the attendtion of the Judge if they proeed to court?

    Yes, they would be mad to take this to court imo.
    You never know how far you can go until you go too far.

    Thanks for the tips and help so far. I will complain to APCOA as Coupon Mad suggests. Apologies if I am missing something but I have spent ages trying to find an email address for APCOA - both on google, their site and on here. I cant find one - can anyone assist please? Many thanks
