Pedant alert - it's could have, not could of.1 -
Laurelii said:Ive heard It does vary on employer however the basic reference states they can only give employment start and end dates and job title. They cant or shouldn't include anythung that could risk your chances of not hetting another job. For example if they did include it and because of their references your a year/ 2 without a job you could sue is this correctGoogling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!1

If something that is false is included in a reference and someone doesn't get the job just because of that, then that could be progressed for compensation but, as elsien says, if it is the truth there is no case against the reference giver.Laurelii said:What if i fake the reference from the previous employer?
No, you can't fake the reference from the previous employer - unless you provide a fake address to which the current employer writes and it would leave you open to being taken to court for obtaining money by deceit (fraud).
If you mean provide a fake testimonial well yes you could do that (in that it is physically possible to write something out and present it) but it would still be fraud.1 -
Some employers ask for more than 1 referee but, in my line of work, one has to be from your last employer.
I think you've already been 'economical with the truth' in keeping quiet about the main reason why you left your previous job. Hopefully, your recent record with your new employer will encourage them to give you a chance.1 -
A wise colleague once told me, "If you tell a lie, you will have to think of another lie to cover up the first one if you get found out."1

It might be worth asking the previous employer what their reference policy would be, or what they'd say in your case. IF you're lucky, they'll say they only ever give a factual start and finish dates reply. But they'd be perfectly justified in saying 'started this date, terminated that date for true reason'.
