Need some advice - used car issues

Sorry but I would be grateful for some advice. 

I bought a car from an independent dealer in 2022. Miles on odometer 12750 miles. Within that period the car had 1 year warranty and I have been able to extend this with the manufacturer.

Fast forward to Monday I sold the car to WBAC and agreed on a price signed the invoice and off I went. 21069 miles.

Yesterday they called to say they can't proceed as there appears to be a mileage difference based on records they hold at WBAC and a ECU reading.
In essence miles are incorrect estimated and manufactured warranty is void. They think the car has done 11000 miles more.
They have offered to lower the price by 15k! Or return the car.

All supporting evidence - hpi MOT check service history are all fine no discrepancies.

1. Can WBAC back out as my evidence doesn't support their claim
2. Can I go back to the independent dealer to seek compensation for the difference

Any advice would be great

    I take it that you haven't received the money for the car yet.

    Yes, they can back out at this stage and must return the car to you at their expense and without further damage.

    I suggest that you inform the dealer (maybe refer to a prospective buyer rather than WBAC) and ask for their view.

    So it's still under warranty?

    Thanks for the reply.

    They haven't paid out - the ECU reading was taken back in 2021 WBAC sold the car in Nov 21 with inaccurate miles logged.

    I have asked for their current reading as evidence.

    In contact with the dealer I brought the car off but would like to know what options I have ? If any?

    It's a 2020 plate so warranty is out but I was able to get extended warranty on a monthly basis.

    Was that HPI check one that you did and paid for yourself?
    If so, I understand that the HPI check will have included cover for this eventuality.
    If the HPI check was carried out by the seller dealer, the protection is vested in the Dealer, not the Purchaser.

    How did WBAC get to £15k value delta for a 11k extra mileage?  That seems entirely inconsistent.  What type of car?

    To clarify its a BMW M car

    1. I bought the car in 06/2022 from an independent dealer at 12750 miles on the odom. Since then i have had no issues with car. Any issues has been handled with BMW dealers in the UK. Servicing and also warranty aspects - the car had 1 year warranty left then i had extended warranty placed on the car. Service logs checking when and the miles and HPI check done by myself all clear (HPI check i just did now) Dealer advert states

    2020 SCH 16miles
    2020 run in service 3281miles
    2022 service 12908 miles
    2023 service 15877 miles

    MOT first one done in 2023 no issues 

    2. I have looked to sell the car and went through WBAC. I accepted the offer and of i went. Got a phone call to say they have had the car looked at BAC auction - they think there is a mileage inaccuracy and have reduced the offer by 15k or if i dont accept WBAC will have to return the car. 

    3. BAC - have said this as they have seen the car in 2021 - when they sold it in Nov 2021 with mileage inaccuracy and warranty void. - WBAC sent me a screen shot of what BAC told them. 

    This is all news to me as i based purchasing the car on what i was told at time of purchase in 2022 with nothing mentioned of mileage inaccuracies or warranty being void. not sure if i did a hpi check myself at the time. 


    BAC wont let me pick up the car until WBAC have paid them the feed and authorised. Also i am concerned about registered keepers. WBAC have assured me that DVLA will remove them as i received an email to say the car is sold.

    I think that miles read as km is a possibility.

    I had that with an MOT where they put in 80k miles instead of 50k miles.

    Any BMW dealer doing a service or warranty work on the car would have picked up on any mileage discrepancy immediately.

    It's not long since we had a recent issue with WBAC changing price / mind on  BMW M.  That was about whether the car was a pre or post model revision

    Any advice on what my rights are as i am getting no where with WBAC and BAC wont speak to me? 

    I also found a HPI check in did before purchasing the car but didnt complete the VIN section. 

    Will be speaking to citizens advice tomorrow and a local solictor
