UKPC DCB Legal court claim after lost Popla appeal

    Almost right, but 12th January is a Sunday.

    With a Claim Issue Date of 10th December, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 13th January 2025 to file a Defence.

    That's over two weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
    I will definately not wait till that date, I want to send it asap so I don't have to think about it. Thanks for your input!

    Because everything goes back to normal on that day,  which is the date that many businesses and such reopen and many staff resume work after the Xmas break   ( I thought it was obvious why I chose that particular  date )

    Its also one week prior to the deadline date,  plus the new year has already started

    Hello all, I received Form N180 and filled it out. I am about to send it, just having one question and couldn't find answer on the forum. When sending it to DQ.CNBC@justice... via email do I also copy the Claimant (UKPC) or only their representative DCBL?
    Please advise.Thanks

    Trying to copy in the parking firm when they are using a solicitor (for a reason!) would be like sending your seller vital legal documents in person, when wanting to exchange contracts on a house you are buying.

    It never ceases to amaze me when we are asked this when there's clearly a legal firm handling the claim.

    Thanks for response. On the form it said send it to ALL parties. Legal language is not easy to read or use, espacialy if one is not a native english. It really is very stressfull and confusing for people who are not doind this sort of stuff on a daily basis. 

    One last question, I got the date for mediation. To which point DCBL can stop pursuing this? I.e. cancel the claim? Is it too late now? Should I start preparing for the court?

    DCBL are not involved in this case,  DCB Legal are, it says so on your claim form 

    DCB Legal will continue the process for as long as their client,  the claimant,  instructs them, even as far as an actual hearing   ( but DCB Legal wont attend court,  but the claimant may employ an advocate to represent them in court   )

    The client can discontinue at any point up to entering the courtroom 

    Mediation is about finding a compromise,  nothing to do with the case itself,  all explained in the defence template thread and the newbies sticky thread too

    Court is months away,  if at all. The typical discontinuance is usually close to the court fee deadline,  so in several months time

    You know what to say because the Template Defence first 12 steps give you some links.

    Again, you'll know this won't go to a hearing and you'll know exactly when they'll discontinue, if you read a few discontinued claim threads.
