Debt letter from DRP - Euro Car Parks

My wife has just received a debt collection letter from DRP on behalf of Euro Cark Parks. They traced her through DVLA as the first two letters went to an old address.

My wife panicked when she received the letter and phoned the company. Who threatened her with court - saying that the court would fine her £1000 for not updating her V5C.

I'm sure you get lots of threads like this - but do we still just ignore this, even if we have missed the first two letters and my wife called them?

    A clear case of not having read the NEWBIE sticky; I suggest you start there and come back when you have specific questions.  They will have used a tracing agency to find  your wife, they are only allowed to ask the DVLA once for the RK's address.  The court won't' fine her £1,000 but the DVLA might be interested -suggest she updates her address on the V5C now and it can be done quickly on-line.

    Right, so as per Post 4 - we will continue to ignore them, I'm assuming that's correct.

    Is there any scope in sending Euro Car Parks an email template asking them to delete any old contact information and to send any future correspondence to our new address? So that, if in the unlikely event that they did take us to court, we actually got sent the court documents?

    Yes, except you instruct, not ask. The keeper should send a rectification notice to the DPO of the PPC instructing them to erase their old data and replace it with their new address for service, and to instruct their agents to do the same. They will need to include proof of ID such as a redacted card/bank statement or utility bill.
    Make sure to use the word I have highlighted as it has a specific meaning where data protection is concerned.

    Same to the debt crawlers.  Erase that old address.

    She has no fine and they completely misled her about the £1000.  Just ignore them - but tell them if you move house again, of course!

    Get the retail park to CANCEL the PCN now.

    I thought I saw a template earlier, but now I can't find it. I have tried searching the forum.

    Is there a template available for this email?

    Right. So on one hand you are telling me to use exacting language, and then when I ask for a template I get vilified? Honestly.

    I remember seeing a template for something like this, maybe it was just Post 2 on the Newbie sticky.

    I understand that you deal with thousands of these kinds of posts every day, and you guys know your stuff. But the people that need help, aren't experts. So we worry about getting it wrong. All I am doing is crossing the T's and dotting the I's. I don't see why the replies have to be so snarky.

    I don't think any poster was being snarky, just helping you to help yourself; we don't like templates (apart from the standard defence) as it detracts from the passion/anger/feelings of the writer and recipients recognise it for what it is and bin it!  Perhaps a better phase would have been "a form of words". A search of the forum found this, a form of words that I and other posters regularly suggest: -
    With the subject line "Date Rectification Notice" send an email to the DPO of the PPC and anyone else that has been involved, including the CNBC and instruct them to rectify your data by erasing your old address and using your current address for service.  Furter instruct them to inform all and any of their agents and sub-contractors.  The highlighted words are there for a reason and should be included. You do not want to risk them sending a claim to an old address and getting a CCJ by default.

    Also important and urgent to get the address on the V5C amended.
