although others may or may not disagree with me I think for me that the fact they paid by credit card means they had a credit agreement on the car and therefore can pursue them for the money

I'm inclined to agree with @Grumpy_chap and @km500.

Wouldn't this be a straightforward s75 claim  -  "goods not as described"?

(I'm making the assumption that when somebody offers something for sale they are impliedly representing that they have good title to them)

Or simply failure to supply goods at all (to which they have title).
  • What the mean S75?
Court agreed that money must be back to me, but when they start to process from court the company informed that started processing by liquidation team. If court said Yes, they need to be pay. But liquidation finally report said not enough for unsecured creditors to pay.

it means that because you cannot get the money back from the person who sold you the car you go to the credit card company and ask them to give you the money back for the whole car because they are jointly at liable for the debt

S75 is a process whereby the Credit Card company is equally liable with the Trader.
If the court found in your favour and you have not been able to recover the funds from the Trader, then you can submit a S75 claim to the CC.
  • Can you help me with that?

Section 75 of the Consumer Credit Act https://www.legislation.gov.uk/ukpga/1974/39/part/VI
    If it sticks, force it.
If it breaks, well it wasn't working right anyway.

Contact your credit card bank and tell them you want to make a Section 75claim.
