Parking eye / DCBL collections bailiffs ltd

I desperately need some help from you guys!

Yesterday i received a letter from DCBL collections and bailiffs ltd stating that i have a unpaid parking notice/fine from Parking Eye Ltd, this confused me as i had not received any initial parking notice/fine so was unaware i had done anything wrong.

I called DCBL today to ask why they had not send out the initial parking fine (pay reduced fine etc or appeal) and they said it was sent to my previous address, i then replied with "my drivers licence was changed immediately to my new address as the law states you must do that, DCBL then said they asked for my v5 details which was registered to my old address when i lived there.
They do not want to give me any leeway or accept anything else apart from the increased fine of £140 or they will summon me to court and slap me with  a CCJ.

The parking notice/fine contravention was 09/06/2023, i usually keep my receipts after being stung by them once before, i simply paid the reduced fine then sent my asda receipt to show i was taking my elderly mother shopping and usually £300 quid later she's done her fortnightly grocery shop and had a mooch around, once i had sent the receipt they sent out a cheque for the fine i paid them.

What advice do you guys have on what i should do next, as the date of contravention is june 2023, and i don't have receipts all that way back and it seems either pay the £140 which i didn't do anything wrong to deserve this or goto court and fight this?

Its giving me crazy stress and didn't sleep a wink knowing there is every chance i'll have a CCJ, be in court all for a parking fine when i simple stayed a long time in asda because my elderly mother needs her grocery shopping.

    Firstly, if you haven't admitted to being the driver don't. Secondly don't pay or offer to pay anything.

    Then read the newbies threads several times to understand where exactly you are in the process. 

    Even if Parking Eye do issue a court claim against you (which they don't seem to be known for) you will most likely pay nothing and even if you lose not as much as they are claiming now.

    And a CCJ only becomes an issue if you lose in court and fail to pay within a month.

    Yes but its been passed on to this DCBL collections company, but if it goes to court and i lose then it wont just be the unfair £140 i pay it'll be substantial court costs also right?

    No. Wrong.

    Firstly, DCBL hardly ever follow though to a court hearing. Usually they discontinue before any hearing.

    Secondly, you imagination of 'substantial court costs' is flawed.
    If this case ever gets to court and by some misfortune you lose the case, then a likely total bill will be around £200.

    When they have a dodgy case like yours, they farm it out to a third party to ret and scare you with legal jargon etc.  Parking Eye are happy to go to the next case and let DCBL waste their money on a rubbish case.

    And the "Can't Pay" logo ... just a rubbish TV soap program

    That is only a powerless debt collector letter and clearly Kim who signed the letter does not have a clue about the Supreme Court case.   Standard stuff from DCBL

    It is not a fine.

    For reference, DCB Limited are powerless debt collectors and cannot take you to court. If they said that, they are lying. All they can do is send you poor quality bog paper.
    As for the "Can't pay, we'll take it away" rubbish, the programme was taken off air in disgrace and not reappeared since.

    Do not however ignore anything from DCB Legal Limited, who are solicitors and can act for ParkingEye.

    Plan A is always a complaint from the keeper to the landowner and the keeper's MP, and it is never too late to do so. 

    Never, ever 'phone an unregulated private parking company or any of their agents. If they call you, hang up immediately.

    Im not used to this jargon so please excuse my asking of what exactly do i need to send to them in a email? Just that they have my address of my v5 wrong?
    And to update their records? So any further correspondence comes to my actual address and not my V5 address?
