GelatoMan said:So pleased can I have some help. My daughter has been very ill so I have not given this the attention it needs.
I made a WP settlement offer of £30 they rejected and asked for £130 I offered £80 they ignored th offer.
The case is on 25th September and I have not submitted a Witness Statement, is it too late I was not asked for one, given a date for submission and I don't know how to submit it
Any help would be amazing
Thank you
You MUST attend the hearing tomorrow.
I hope you win but we couldn't influence anything for you because you came to this forum very late, with a claim form already received. Then you complained to us that the defence 'didn't work' (see above posts...it wasn't intended to work).
Then 24 hours before your hearing we are told that you haven't done a WS. Sadly, we've had no chance to help you. I wish we could have and hopefully the Judge will see your side.
Attend the hearing without fail. Take a copy of your defence and be very familiar with it and why the PPC can't add money on top of a parking charge. Hope the Judge lets you speak even though you are not a 'witness' without a WS.
We assume you received their WS bundle?
If not then there is a chance the claim has been discontinued but there's no time to ask the court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you, for your reference at no point have I complained, I have thanked everyone who responded and been appreciative this is all voluntary.
I also did not ask for your particular brand of passive aggressive behaviour, if I don't like something or someone I am clear about it, like right now.
Perhaps if your daughter has tried to kill herself.you might have lost focus on this! Your compassion or empathy are not required or expected.
From your tone and attitude I suggest you apply for a job with ParkingEye @Coupon-mad you'd fit right in!
Of to fight my case now and BTW speaking kindly to the Court caused my witness statement to be accepted on Monday, so you were wrong on that.0 -

Here https://forums.moneysavingexpert.com/discussion/comment/81008296/#Comment_81008296 you said the case was on 25th September but today at 12.59 you wrote that you spoke kindly to the court and your WS was accepted on Monday! Do you mean next Monday (30th September) in which case have they moved your case? If they accepted your WS on 23rd September, did you attend court today? If so, what was the outcome?2

On Monday I took your advice and submitted a Witness statement directly to the court by email after speaking to a court official and explaining the circumstances. He uploaded the statement immediately and forwarded it to all parties. (Monday 23rd)
I went to court yesterday (Wednesday 25), first I was shown into a small meeting room where a man identified himself as the legal representative of Parking Eye. He had a copy of my witness statement but said he would move to have it struck out. I said I was confused as to why I was meeting with him, he said it was to Narrow Down Issues. He then proceeded to tell me why I had no case and should settle, I said I had offered to settle WP twice at £30 and £80 but these had been rejected or ignored. He said he was now able to settle at £195 plus £165 his fee (£360). I said I saw now benefit on settling on that basis. He said he would call to see if he could get his fee waived, I said I felt I had a very good case and unless he had a better offer to make I wished the case to be heard.
We went in to the court at 3pm, it was a big room with just the Judge and the two of us. The judge began to speak but I could not hear what he was saying over the Aircon. I told the judge I couldn't hear he said he apologised said had a cold and could not speak any louder. He then read guidance about fairness and adjourned the case untill after Jan 4th 2025 as I am out of the country from October 13 to December 30th. The lawyer for ParkingEye asked for Costs to be reserved the Judge agreed. He also advised there was now further opportunities to settle out of court.
On leaving the court the lawyer was very friendly and said he could also found it very difficult to hear the judge over the Aircon without and amplification.
So this is where I am with the case.2 -
You don't get it to discussion with rent a reps in the way you did

Worried that costs were reserved.
You should have asked for no order as to costs (because the adjournment was neither party's fault and neither should profit from this abandoned hearing) but we know that a litigant in person wouldn't know that it might matter.
Also: the rep lied to you: he never could have his fee! Next time don't go into a meeting room with the other side's rep. Our standard advice is to say 'no thanks, see you in front of the Judge'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
