    Given that the case has escalated to DCB Legal for recovery action, the opportunity to transfer liability has elapsed and the right to appeal has now been lost.

    Hi, DCBL have tried this on before for UKPC.  SIGNAGE ON THIS SITE is rubbish ..... which is normal for UKPC

    Signs full of small print, high up on lamposts, you need binoculars to read. Worst of all, at the entrance from Vastern Road, just before the railway bridge .... DOES NOT HAVE ANY WARNING SIGN ABOUT ENTERING THE CAR PARK

    DCBL know already as they have prior discontinued another claim for the same site.

    I am local and happy to firstly meet and discuss with you, and secondly go to court with you. The judges in Reading County Court are good and do not take foolish legals lightly

    The three times I have helped someone in Reading Court, we won and frankly with rubbish claims by DCBL this will be another one.
    I had two just before Xmas last year, both claims were dismissed, one for poor signage and the other for frustration of contract
    Both claims added up to over £1300 to which much was the fake add-ons, no different to the fake DCBL add

    Have you seen the famous DCBL discontinuation thread, the majority being UKPC rubbish

    Thanks for this reply. However, this example was for where the driver was disclosed to them, and to cease against the myself. But I have not disclosed the driver, and said in the first email that I was not willing to.

    I will keep this in mind. Though I do not live local, I do not live that far away to take a trip. The pre warning and signage is exactly the issue with this car park, especially at night when this occured. It has been causing me a bit of stress, so talking to someone about it might be a good idea.

    No need to be stressed, it's only UKPC with their famous unreadable signs and no warning signs at the entrance
    Judges do not like this timewasting rubbish in court
  • Update on this;

    I contacted the council to find out who are the rate payers for the land, and they came back with the stores that the car park is for. I contacted each of the stores, and they all said that they couldn't help, since it came from another company and not them.
    I contacted what I thought were the agents for the car park, but they notified me they were the letting agents, and passed my email onto who I was looking for. I heard no more from this.

    Today I have received a claim form. I will be going through the newbies thread tonight, and start writing up a defence to send them.

    No need to write a whole defence. The template defence thread is your go to. Just edit as necessary.

    What is the issue date of your claim and please show us the PoC. This will determine whether you can use the "Preliminary Matter' that could get the claim thrown out before it ever gets to a hearing.

    Thanks, I have just read through the thread, and yeah there is a great template! I see also that it recommends waiting 5 days before acknowledging, and then sending the defence soon after, to utilise the time given.

    Attached is the PoC on the letter I received today.

    Just use the plain vanilla template defence. Your edited bit should not go into any great detail. You are answering the allegation in the PoC that you breached a term that states "No parking out of hours". That is all.

    You will state that no contract could be formed as the signs were not obvious nor prominent enough to bring the conditions to the notice of the motorist. The rest of the template covers everything else you need.

    DCB Legal will eventually discontinue. Just follow the 12 point checklist.
