Dad died no will no one helping me it’s torturous

    I don't want to appear insensitive or anything but you mentioned you are on benefits - if you inherit then you will need to declare this to the benefits people and because you will have capital it may well be that your benefits will be cancelled if they are means tested

    There is of course also the option of just walking away and doing nothing but you need to do that before you get too far involved. If you have already "intermeddled" (and paying for the funeral would not count) then it is too late but if you haven't done anything else it is still a possibiity.

    That will mean that your dads affairs and properties just sit there with no-one doing anything but it is still an option.  It is now several years since my aunt died and no-one ever sorted out the estate. No-one official seems to have noticed yet as the son who was living there continued to live there and paid the bills in his own name. Not something I'm necessarily recommending but until someone sorts out the estate you don't have an inheritance so (and this is only a guess) I don't think it would impact on benefits as yet.

  • There is no point informing DWP of your inheritance at this stage, as you won't receive it for several months or more yet. You need to tell them as soon as you get the money, not  before.
    When you registered the death, did the Registrar give you a code to contact Tell Us Once? It is a useful service which informs the local authority, so that affects Council Tax, Blue Badge and any other service your father may have used. Tell Us Once also informs DVLA, and DWP re Dad's Pension, in case that is relevant.

    If you remain living in Dad's house you will be liable for council tax there and at your rented property but I would say stay until you've cleared the house.

    When I sold my late Mum's property, I gathered everything I could (solicitor provided a crib sheet of what they needed) and sent it all to them.  I'm not a form filler and couldn't face doing Probate myself.  I think it was about £1600 which I paid from Mum's cash.  When the property was sold, the solicitor received the money, took their fee, paid the Estate Agent and sent the remainder to me.  

    Please don't worry about having to pay for things.  You don't.  They will be paid when the properties are sold.

    I am sure there will be issues with your benefits but hopefully, you will be able to buy your own property, make it work with the benefits you can claim, and move on with your life.

    I was advised that there are two ways a solicitor charges for probate - a fixed fee or by the hour. If it's complicated and requires a lot of work the fixed fee is best (get an estimate) but if it's straight forward then by the hour is better value. 
    As above, I was given a 'crib sheet' and blank IHT forms by the solicitor and mums IFA. I got all the paperwork together and in order and annotated in a file. This was the most time consuming bit and saved many hours of solicitor work. The estate was charged by the hour, around £600.
    (There was no IHT to pay but the forms were needed for a reason I still don't understand)
