UC/CARING/MIGRATION HELP PLEASE

That would be correct if he is employed, but if self-employed on WTC there is no earnings requirement or requirement to earn the minimum wage. So it is possible to claim WTC and CA. Obviously if HMRC investigate the self-employment you would have to demonstrate you were actually trying to make a profit and you were actually physically working 16 hours a week.NedS said:CGG_3 said:Thanks all, for taking the trouble to the reply. He declared working 16 hrs/wk to tax credits and declared the CA figure to them ,each year. (Using the same figures on his Self Assessment).
He told UC he claimed CA, too, in his initial application. That is contradictory and he should not have been claiming both WTC and CA.16h/week of work implies a minimum of £166.88 at NMWThe eligibility for claiming CA states earnings of £139/week or lessYou can't have it both ways.If earnings were actually less than 16h/week, then WTC should have ended and there would be no entitlement to managed migration or UC due to capital exceeding £16k. You are playing a very risky game, although luckily you can easily afford to repay any overpayments should you later be found to be ineligible (Tax Credits are still issuing overpayments now for many years ago)1
