Change Of Solicitor?

I have a personal injury compensation claim in progress. I have told the solicitor right from the beginning about my injurys as time went on I updated the solicitor on this. But now I feel the solicitor only wants pay attention on 2 particular injurys and the rest I feel like she is ignoring.

Like I told her last year that I have ptsd due and tinnitus and updated her as time went on like when I was started on medication.

Yesterday I sent her a email to ask I understand that I will be seeing the orthopedic expert for a report but what about my psd and tinnitus who will I see for this her reply was.

Do you want to claim for these

Make yourself some notes of what you're going to say before you make the call, because you are guaranteed to start feeling even more upset as you start talking. There may be very good reasons why she is focussing on 2 particular injuries, but you need to know. Make sure you have the dates and details of when you told her about the PTSD and tinnitus, how you told her (email, phone, letter?) and draw her attention to when you made it clear to her that you wanted these conditions included.

    If at the end of the call you are still unhappy, then say you wonder if it would be better to transfer the case to one of her colleagues.

    How is the legal advice being paid for? You personally; insurance (e.g. home legal fees cover); or no win/no fee? Is it on a time/cost basis (ie payment is directly linked to the amount of time spent on your case), or a fixed fee?

    Alternatively, if you really can't face talking to her about this, do a simple chronology (a list of dates and events) briefly setting out what you told her, and when, about the issues you feel should be included, and how you told her (email, in person, letter, telephone). Try to keep it as factual and unemotional as you can, because that way it carries more weight. Send it to her and ask how best she feels the case could proceed, because you are concerned that matters raised form the outset are not being included and you need to know why she feels that is the best way to handle your case.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    I do have legal expenses insurance with my building policy. But there condition is that they will only cover me if my case goes to court proceedings.

    I have been told by the solicitor that the other party have accepted liability they accepted liability in November 2022. She also notified me there will be no need for court proceedings. Unless the other side give a very low a  unacceptable offer.

    Do you think that it will be a easy process to transfer the case to one of her colleagues. I mean could they refuse? I am the client and going to pay them 25% from my compensation.


  • It sounds a bit confusing having several different injuries which may or may not be related. For example if a company agrees fault because of an accident and you suffered a broken leg but you also want to claim tinnitus for working next to machinery, these would be unrelated and I would understand the solicitors wanting to pursue one before starting on the other. Also if one injury has significant back up of doctors or specialists report and one is just a suspected claim then they would pursue the former. No win no fee will go for the one which will pay them, they are not your personal solicitors which you are paying throughout and so you may need realistic expectations of the service they will deliver.     Thank you for your reply. All injuirys are due to the accident and related I mentioned to her from the onset. And then kept updating her as things moved on. Like with the ptsd I told her GP has put me on medication and then later on updated her that gp has now done a refferal to talking therapies. I have sent her report letters which show how ptsd is affecting me.

    How is your agreement with the solicitor structured - is she a 'named individual' and you are contracting with her, or is your agreement with the actual firm?

    Well all the paperwork says the solicitors name on it and she works for them as I understand her position is senior associate.

    I’ve never heard of solicitors in a firm entering into personal contracts with clients.

    There’s no principle that a client can dictate which individual deals with a case, firms will always want flexibility to allocate work how they wish.
