I've now had an email from a paralegal at DCB Legal Ltd."For the purpose of clarity, the sum added is a contribution to the actual costs incurred by our Client as a result of your non-payment. Our Client’s employees have spent time and material attempting to recover the debt. This is not our Client’s usual business and the resources could have been better spent in other areas of the business. Had you of paid as per the Contract, there would have been no need for recovery action so the amount due would not have increased.
Please note, the HMRC ‘VAT Supply and Consideration manual’ (VATSC06140), which was last updated on 02 September 2020, confirmed that Parking Charge Notices fall out of the scope of VAT.
As per your request, your file will remain on hold for 30 days from the date of this email. After which, sufficient evidence of the payment ticket on the date in question is to be provided, or payment of the outstanding balance of £170.00 will be due. Failure to do so will result in a Claim being issued against you without any further reference. "
I've replied via email attaching my RingGo confirmation along with my comment:
"In response to your comment that 'resources could have been better spent in other areas of the business'. I couldn't agree more that the hassle and distraction caused by this erroneous charge is a waste of time. Please advise your client that I wholeheartedly agree that their attempt to charge an extortionate penalty fee for this is not a good use of my resources or theirs."
I'll advise if/when I hear any further from them.

Rest assured that when they file the claim (they will) they will immediately be breaching the following CPRs:
- CPR 1.1
- CPR 3.4
- CPR 3.4(2)(a)
- CPR 3.4(2)(b)
- CPR 27.14
- CPR 27.14(2)(g)
