Submitting PA1P : IHT summary

The PA1P checklist includes a request for Inheritance Tax summary
Our case in a excepted case, 1st death of couple, leaving everything to spouse.
Only need probate to later transfer house in sole name to survivors name

Is a printout of the "online Inheritance Tax checker" (reports no IHT to pay) results sufficient for this purpose or is something more detailed required ?

  • Was the house in the sole name of the deceased? Probate should not be needed for a jointly owned home.

  • Can I jump in here please & ask @Keep_pedalling - when you say Probate not needed for a jointly owned home, do you mean owned as Joint Tenants (I know probate not required in those instances), or does owning as Tenants in Common also mean no probate is needed?

    I'm going round in circles trying to find the answer to this question. Have spoken to Probate Office, who directed me to Land Registry who said Probate wasn't needed but in a rather wordy way & when I tried to get clarification told me to speak to Probate again! 

    Which I haven't done yet. 

    The whole reason I started querying was because somebody told me because the house was TIC & StepFather has a life interest it didn't need to go through Probate... 🤔

  • Probate is not required if the surviving owner inherits through survivorship (JT) or though a will or the laws of intestacy intestacy (TIC)
  • Just to restate my question before it gets lost .....

    Most people now are applying for probate online, why are you doing the application on paper?  Be aware it will take several weeks longer for probate to be granted for a paper application.

    Anyhow, sticking for now with the paper form PA1P:
    • You would only include form IHT207 if the person lived abroad.  Assume this is not the case.
    • You would only include forms IHT205 / IHT217 for deaths before 2022.  Assume this is not the case.
    • Therefore I would expect that you have answered "No" to questions 7.1 and 7.3 and "Yes" to question 7.5.
    • You have provided summary values in boxes 7.6 and 7.8, this is all that is needed for an excepted estate since 1st Jan 2022.
    If all the above this true, there is no need to send any inheritance tax paperwork to HMCTS.  Had you completed the probate application online, the checklist on the coversheet would not have listed any IHT paperwork.
  • We are doing a paper application because the Executor is not making the application, we are using the PA15 Renunciation form 
    The online process wont allow that
    2 Daughters are making the application, Mum is the named executor, but at 90+ would not be easy for her, hence wanting to use the Renunciation form - Thats a valid use I think ?

    On your 3rd bullet, those question numbers don't quite match my paper copy of PA1P ?

    7.1 Died after Jan 22 : Ticked
    7.2 Which Forms  : Ticked - did not have to submit forms
    7.3 Values of Estate for IHT .....
    7.5  Provide Gross and Net values  ....

    Anyway we have provided summary value in relevant boxes , so no need to to send anything additional then

    That makes sense, I just wanted to make sure you were aware of the impact of doing a paper-based application.

    Aha, I see they've issued a new version last month!  I was still looking at the old version.  The new version is much easier to follow, as they've split out pre-2022 deaths into section 8.

    With the new question numbers, that all looks fine.
