Horizon Parking charge on hire car

Hello,

I have received a parking charge notice from Horizon Parking. They claim I parked for 3 hours and 14 minutes at a retail park where I visited Home Bargains, The Food Warehouse, B&M Home Store and McDonalds. The PCN gives no details of the amount of allowed time, but I assume it was ‘3 hours maximum’.

The car I was using was a hire/loan car from a Nissan main dealer - my car was in for a service. I was with my elderly father, which led us to take some time getting around those shops.

I’ve read the newbies thread and wanted to check if my situation (hire/loan car from Nissan) is the same as the ‘* COMPANY, LEASE OR HIRE CARS ANYWHERE IN THE UK’ section - i.e. do I need to contact Nissan to make sure they don’t pay the charge? The PCN has been sent directly to me, so does they mean Nissan are already removed from the loop?

Does this situation increase my liability, given that Nissan loaned me the car?

Part of me feels resigned to paying the fine and being done with it. But reading other comments on this forum makes me want to fight these dodgy companies and not just comply.

    Yes just use the Edna Basher lease/hire car appeal version.  You can't lose and it's not a fine.

    Do not add any detail like 'I was taking my father out' because that tells them who was driving and ruins the 100% win!

    Dear Sir,

    Parking Charge Notice [XXXX]: Vehicle Registration [XXXX]

    I refer to the above-detailed Parking Charge Notice (“PCN”) issued to me by Horizon Parking Ltd (“Horizon”) as a Notice to Hirer. I confirm that as the hirer of this vehicle, I am its keeper for the purpose of the corresponding definition under Schedule 4 of the Protection of Freedoms Act 2012 (“POFA”) and I write to formally challenge the validity of this PCN.

    You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge. There are a number of reasons why Horizon's Notice to Hirer did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular.

    Given that Horizon has forfeited its right to keeper liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (POPLA), their contact details and a unique POPLA appeal reference so that I may escalate the matter to POPLA.

    Thank you for your cooperation and I look forward to receiving your response within the relevant timescales specified under the British Parking Association Ltd Code of Practice.

    The PCN I received is the same as the Horizon one in A thread of Pictures of parking firm NTKs - although the first PCN I received is 'Notice to Hirer', and the follow up 'Notice to Keeper'. It's noted on the thread these are 'always non-POFA'... although I don't understand how so.

    Great result. I know you weren't affected by the practice below but hope you will support and sign this petition.

    So many people don't receive 1st and/or 2nd pcn but the £170 payment due letter often manages to drop through letter boxes. PPCs always claim discounted rate/full rate pcns/court claim letters were sent as dated though they offer no evidence to prove this.

    Since they CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and see it included in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024.
