    Reading that thread @Coupon-mad has worried me a bit.

    Please can I ask, are the timings and process pretty much the same as bargepole’s “what happens when” now I’ve filed a counterclaim? Am I now just waiting for the DQ?

    Do they have a time limit to send a defence to my counter claim? Is it effectively 2 sets of paperwork from here on in? One for defence and one to counterclaim? Or do I file it as one WS like ellaro9 did in the 90 seconds thread?

     
    I saw the OP’s paperwork was a bit all over the place on the thread you sent me to look at and I don’t want to be in that situation 

    Theres nothing special I have to do now I’ve filed a counter claim?

    Something to brighten the rainy, miserable day. DCBL filed a defence in good time, it’s a work of fiction but it’s a defence. How can they sign the statement of truth? 

    6i. They say I failed to mitigate in the circumstances, I emailed both I Park and DCBL 4 times and told them it wasn’t me.

    I did provide I park services with ID but they still refused to provide me with the SAR. DCBL replied with automated replies to my SAR requests, and are moaning that I didn’t provide ID to them. Now, magically, without any further input from me, they've messaged to say they’re now working on the SAR (only 1 month late)

    Then, in 6v. They claim any distress I’ve suffered is because I’ve not paid up 🙈 I’m innocent, why would I?

    6vi it the worst part. They CANNOT under any circumstances have got my data from the DVLA

    I’m now receiving a few letters and emails a week instructing me on how to “assist the court to achieve it’s overriding objective by settling”. Surely not bringing bogus claims against innocent people would assist the courts greatly.

    I think they've traced someone with a similar name to yours and found you by mistake.

    Unless you hired it or used it as a courtesy car?

    If not, I suggest you should counterclaim for data abuse as well as defending, and I don't think you should use the template defence.

    Send I-Park a SAR by email to their DPO now, asking for the source of your data including the soft Trace results from the CRA that erroneously returned this postal address because you are the wrong person and have never owned, hired, driven or been registered keeper of this car so you require them to cancel the PCN and Claim immediately and erase your data, or you will counterclaim for not less than £300 in damages for distress.

    Copy in info@dcblegal.co.uk

    Do that now, first. Use those words: 'wrong person' 'erroneously' and 'erase'.
