Car park - claim form advice

Yes that's right. Hearing is on the 6th Dec. Got an email from UKPC a day ago asking for settlement in advance of them paying the hearing fee. 3 days to accept, tempted to ignore.Coupon-mad said:I'd say this OP is past the first 12 steps as they are past WS stage.
Hearing must be soon. Or discontinuance!1 -
Ignoring settlement offers is par for the course, at any stage, especially last ditch offers before the hearing fee is due ( I would have thought that the legal team would be making the offers. )
UNLESS they gave a drop hands offer, both sides walking away and bearing their own costs
You have been ignoring the offers from the get go1 -
Was this a UKPC claim filed by them, without a solicitor? We've never seen one of those progress as far as a hearing and I expect them to discontinue this week.lam2222 said:
I parked at a Mad house - child play area for a birthday party. They have free parking in a car park but some sections of the car park are UKPC private parking bays (I think, the layout is quite confusing). I must have parked in an incorrect section.
Just a reminder that you need two appeal exhibits, CEL v Chan and CPMS v Akande.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They are using QDR solicitors. Yeah CEL v Chan and Akande were both referenced as a preliminary matter in the witness statement.2 -
DAMN! QDR are more likely to take a case to a hearing. They send LPC Law reps to hearings who argue all sorts of rubbish and who I think are also (probably) the IAS adjudicators.
Conflict of interests, much?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So that email came from QDR in fact?lam2222 said:

QDR are like a dog with a bone but beatable .Their cause of action is based on “5. The driver agreed to pay within 28 days but did not D is liable as the keeper. Despite requests, the PCN(s) are outstanding. “- it is doomed to fail on that point and everything else should fall away.I would mention this near the top of your WS . Exhibit a clear image of the sign to allow the judge read every word of it.2

The offer to settle email came from claims@ukparkingcontrol.com. I mentioned QDR as the letter from the enforcement agents (GCTT?) said they will pass it over to QDR. That was over a year ago.Coupon-mad said:

Yes exactly that. The fact that there's no mention of 28 days on the UKPC notice is a preliminary matter in the WS, along with a photo as an exhibit. The sign does have a mention of 'if you pay within 14 days the charge is reduced etc' but no mention of 28 days.Bazarius said:QDR are like a dog with a bone but beatable .Their cause of action is based on “5. So your claim wasn't filed by QDR then.lam2222 said:

You know this from your Claim Form.
UKPC presumably filed the claim in-house but only you know that from the details on the left of the Claim Form.
This is important info, for us to correctly advise you. UKPC themselves are not going to turn up at hearings and discontinued one we saw on the forum today. They'll discontinue yours.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
