Yep - nothing at LBC stage matters really!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • Ok won't bother then, I'll just respond with the response from the NEWBIES thread
  • Assume this is OK to send? (i've added a bit about the PCN falling under the grace period...)

    Dear Sir/Madam,

I am writing to acknowledge receipt of your letter dated 19th August 2024.

The alleged debt is disputed and any court proceedings will be vigorously defended.

I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

I dispute the claim as there is no sustained duration of parking, at 12 minutes the PCN would fall under the grace period allowed by the International Parking Community Code.

I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £
185 represents a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yours faithfully,

You have the wrong DRA fee amount in question 1

Have you seen the generic reply template in the NEWBIES?
  • Yeah that's what this is based on, since the fee has gone from £60 to £160, I'll change to £100

Wasn't the initial fee £100 but discounted to £60 if paid early?

So it's the 'additional £60' - bringing it to £160 - that you are challenging.
  • Got it, thanks!
