MET PARKING FINE at NUFFIELD CLUB

Dear members here I share with you another robbery attempt

I received a fine for parking at my club , I am a member and have a right to park there ,  they had a machine to record car reg num which I entered my reg in but still got a fine on the windscreen, I spoke to the manager who acknowledged from CCTV that I did enter the reg and said that  some times the machine doesn't register the number correctly , he took the ticket off me and said he will sort it out for me .

 I forgot all about it until I started getting claim letters from Debt collectors from MET parking , having been on this forum I knew I could ignore these but I did reach out to the club again asking them to speak to the parking company and remove my fine as their ipad  recording machine not working properly was not my issue.

The manger assured me they will email them. I never bothered to get in touch with MET parking directly however months passed and I didn't see any letters of the fine getting removed , eventually MET sent a claims letter , I spoke to the club again and explained the situation however I was told that the manager who took my ticket off me to deal with the case had left the company the new manager did send me an email on my request confirming they do not wish the fine to be applied as I am a legitimate member of the club and that the previous manager had left without getting this matter resolved, I attached this with my evidence of my defence and sent the documents as directed in the newbie guide.  I have got a hearing date letter now from County court.

I have a few questions at this stage -

1.Even though I filled out N180 form and send them they send me a mediation appointment offer email , I replied to it and declined to attend and attached my N180 , my question is is this usual for them to send a mediation email even when we said no to it?

2.I have recently received a court date letter but I have misplaced that I was moving a lot of furniture I have emailed the court to send me a copy of notice of allocation to the small claims track but want to know if there is a portal where I can go get it myself with the claim num

3. I want to submit witness evidence and as past of that I want to request a SAR from MET parking , where can I find a request template and who should I be sending it to ?

1. Yes.  You were correct to refuse.

2.  No, there is no such portal. Ring the court again for the dates, times & deadlines on the Hearing Order, or ask them to email it to you.  Or do you mean you still have the Hearing Order and do know your WS deadline?

3.  Don't send a SAR.  No need - and it WEAKENS your position.

OK so you attached evidence but defence was not a time to do that.  You will have to attach that again now (and more exhibits).

If this is a DCB Legal Claim they'll discontinue when they see your WS & evidence.

Hi Guys 

I have received a WS from the parking firm's lawyer I need some help in drafting my own WS from the newbie forum

Hearing is on 24th July 2024

 I can only see **NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou! — MoneySavingExpert Forum , as an example I will use that as a format template but would very much appreciate if you can look at the redacted WS from the parking firm and below facts of the matter and let me know if I can add anything more to strengthen my witness statement and case. I will share my WS when I have it ready

Facts of the matter:

Are stated in the first 3 paras of the first post 

In addition to that I want to add there is no ANPR on the site so the photo was taken by a parking attended, there were  no in and out times registered at the entry and exisits.

I contend that I have been coming to this place for years and always entered the car reg , the fact that their registration machine failed to record it that day is not something I should be fined for 

The manager who assured me he would deal with the issue but didn't do so and left the company some months later is also something that was not in my control

I had not contacted the parking firm at any stage naively thinking that since I am a customer the club will get it cancelled.



As evidence I have collected the following 
Evidence exhibits I will attach in WS: 

1. DDR payment proof of me being a member of the club since 2019 (that's as far as my bank app will go) 
2.Email  from Nuffield manager stating they do not wish to pursue the fine and asking it to be cancelled
3.Picture of the car reg reader located on the club reception

Let me know if I can add anything more to strengthen my witness statement and case.

Study the exemplar cases in the second post of the Newbies thread, 5 names are listed, those WS are the best examples, choose the best fit and adapt it, adding the various exhibits too , because they are not in your list above 

If your hearing is on the 24th and because you have received their WS, yours must be due this week, so crack on with it ASAP

I think you are late sending your WS. I advised you about this in February.  Eek- do it NOW!

ok which email do i send it to? and do I have to send one to the solicitor too? In the newbie thread I can see names when I click on them it takes me to their profile no examples

The NEWBIES thread explains the two places you email it to (and if the Claimant emailed you their WS then you have both email recipients in the header, as they will have copied in the right local court).

Have another look what a Profile shows...

You are expected to look at the threads they opened, click on the correct court claim thread and study the case, each one will have a start to finish case 

You email one copy of your bundle to the court you selected and cc the lawyers
