CCC defence for PCN time changes

I have received a claim form from Euro parks. 

I’ve put in an acknowledgement of service and plan to write a defence.

This is for a petrol station where I had apparently over stayed on two occasions in 2022.

The letter from the solicitor only gives one time and does not mention how long l allegedly overstayed.

This station has a Waitrose plus air which I use regularly in addition to getting petrol.

I’ll be honest and say I remember receiving one of the letters and not the other.

I do know that the parking time was reduced from 30 mins to 15 mins at some point but I don’t know when. This could perhaps account for the alleged over stay.

Your advice would be greatly appreciated on what to put in my defence. (I have seen the template.)

    What is the Issue Date on your Claim Form?

    Upon what date did you file an Acknowledgment of Service?
    Your MCOL Claim History will have the definitive answer to that.

    There are a number of car park operators with 'Euro' in their name.
    Can you please tell us the full name of the Claimant?

    It would help greatly if you can show us the Particulars of Claim from your Claim Form.
    If showing us a picture, please take care to remove your personal information - e.g. reg.no., password, claim number.

    The Claim is for multiple PCs issued to

    vehicle ******* the Vehicle, when parked at

    locations the Sites specified in the detailed

    Particulars of Claim. The Sites are managed

    by Claimant on behalf of landowner The

    Defendant is the registered keeper of the

    Vehicle, or driver named by the registered

    keeper in accordance with Sch. 4 of the

    Protection of Freedoms Act 2012. The driver

    of the Vehicle by entering and remaining at

    the Site agreed to the restrictions and terms

    and conditions set on signages at the Site

    the Terms and Conditions. A contract between

    the driver or the registered keeper of the

    Vehicle and the Claimant is formed. Defendant

    breached the Terms and Conditions and

    Claimant claims damages. Claimant claims 8%

    pa interest under s.69 of the County Court

    Act 1984 or alternatively at such rate and

    for such period as the Court thinks fit.

    Detailed Claim Particulars To Follow.

    I will provide the defendant with separate

    detailed particulars within 14 days after

    service of the claim form.

    With a Claim Issue Date of 18th January, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 20th February 2024 to file your Defence.

    That's just over a week away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    I think that is just short for Parking Charges, which is ok.

    Thanks for that reminder @Castle.

    That in turn means that if the Particulars are yet to be served, then the Defence filing deadline is not as I stated above, but will be dependant on when the Particulars of Claim are/were served.

  • Deemed received on the 6th February. They have just achieved the deadline set by the court. You will need to post the detailed PoC.
