RTM members

I am the co-director of an RTM and we have 3 buildings we deal with, 3 flats each. I took over only because the lady before me sold and no one from the other owners was putting their hands up. So I am not very versed in the ways of RTMs.
Question is, do all owners of the 9 flats need to be members of the RTM? We only have one flat where the owner did not want to be a member, but he is paying a non-member fee and also his service charge on time. Another flat has sold recently so should I send the new owner the New Member form, is it a choice or as an RTM we all need to be in the same boat and responsible for everything? Thank you.

    As I understand it, all leaseholders (i.e. flat owners) have the right to be members of the RTM company, if they want to be. But they don't have to be, if they don't want to.

    I'm not sure that a membership fee is enforceable, and I strongly suspect that a 'non-membership' fee won't be enforceable. i.e. payment would be voluntarily.

    What is the money raised by membership/non-membership fees used for? If it's used to pay the administration costs of running the building, it should be part of the service charge.

    (And leaseholders who think that the administration costs are unreasonable can then challenge them at a tribunal.)
