Boiler less than 3 years old but has been condemned, any legal standing against the manufacturer?

    I spoke with Ideal but all I got was the warranty has run out and have me payment options for someone to take a look and see if they can repair it. Obviously I don't think it's a good idea for Ideal to send someone to take a look and say, yea going to need a new boiler and then pay him for the privilege.

    Do I have any legal standing against Ideal to force them to get it fixed or replaced seeing at its less that 3 years old or is it a case of I'm out of luck, the warranty has ended and that's it? Just got to find the money somehow to afford a new boiler?

    Obviously I'm very annoyed that I've now got no heating or hot water until it's sorted when I've got my wife whose pregnant and my 2 year old who's disabled and needs regular bathing. Especially when it's not even 3 years old and in such a dangerous way.
    Tell me if I am wrong the boiler was new in February 2021, I am assuming you had the appliance serviced in 2022 and 2023 ? or am I wrong, if the boiler was serviced again I am assuming nothing has shown up until your service in 2024.

    Alternatively you have not had the boiler serviced until 2024 to which the boiler has been condemned, if that is the case it may be the boilers balanced flue, you need a second opinion it may be something simple as a repair.

    My gas valve in my ideal combi espi35 failed 2 just weeks after the boiler had its second service.
    in my case there was/is no correlation between service compliance and breakdown. 
    They are just cheap boilers and the house builder could get more efficient and better quality boilers for just a few hundred quid more.

    And perhaps that should be the choice on an extras list a £000's more if you want this boiler over the standard.

    But the fact the manufacturers are only giving 2 years - the EU mandated minimum on many goods - speaks volumes


    That is not the warranty mentioned in EU261. The manufacturer does not have to give any warranty.

    When shopping in the EU, Norway, or Iceland, you are always entitled to a minimum 2-year guarantee at no cost, regardless of whether you buy the goods online, in a shop, or by mail order. The 2-year guarantee is your minimum right EU-wide. This rule have been laid down in the Directive (EU) 2019/771.

    EU law also stipulates that you must give the consumer a minimum 2-year guarantee (legal guarantee) as a protection against faulty goods, or goods that don't look or work as advertised. In some countries national law may require you to provide longer guarantees.


    just 2 such references - but note that is on a normal consumer purchase via retail - online or in shop etc.

    That is NOT a manufacturer's warranty. That is the warranty mentioned EU261. For the UK it is up to 6 years. It allows you to chase the Retailer for up to 2/6 years for faulty goods.

    Dont forget to use him for servicing going forward. Says a lot about the ability level of the person who condemned it that they didn't have the basic skills to fix it.

    We found our local approved company less than useless, 2 attempts and repairing our boiler from squealing in the winter to no avail.
