Couriers refusing to take responsibility

  • Thank you very much for all your input, this has been very helpful and made for a very interesting read.
    ParcelCompare are now looking into the case following an initial dismissal of me.

    I had previously sent ParcelCompare the email where Evri admitted fault and am waiting for an update. It’s been 4 days, so not sure how long I need to wait before following up but I will certainly copy in Evri in my chaser if I don’t hear back soon. 

    Just to clarify, that the recipient didn’t ask for the parcel to be left on the doorstep, safe place or neighbour. It was left after the 1st delivery attempt. Had it been the case I’d leave it to the buyer to deal with but responsibility has fallen to me to refund the buyer as he didn’t receive the item. Unfortunately, making me out of pocket for courier negligence. 

    Should ParcelCompare continue to dismiss me, could you advise how I continue this case with small claims?

    Should ParcelCompare continue to dismiss you, you need to decide how far you want to pursue this.

    The next step will be to send them a Letter Before Claim (aka a Letter Before Action).  This briefly summarises the salient facts, states how much they owe you, and gives them a reasonable period of time in which to pay up (say 21 days?).  If they don't pay up, your letter notifies them that you will issue a court claim against them claiming the amount stated plus court fees plus interest.  (For a claim up to £300 the fees are £50, over £300 is £70)

    If they don't cough up, you issue a claim.

    Many defendants will pay up upon receipt of a LBC, but I suspect ParcelCompare won't.  So if you want your money back you'll probably have to carry out the threat to sue.

    Have you read the previous thread linked to by the lunatic and did you understand what those two cases were about?

    If you are willing to invest a little bit of your time and effort in doing so, go ahead and sue - but remember that when a case gets to court there's never any 100% guarantee of success

  • Thank you Okell, I really appreciate your sound advice. 
    I did read the previous cases, very interesting but as you say, no guarantee with outcomes. It’s definitely something I will consider if they continue to dismiss and put the blame on me for not taking out parcel protection, when this instance relates to delivery negligence and bad service standards. 

    Had this been a loss case I’d have accepted the risk, it just grates me that minimum service wasn’t met and I’m being penalised and feel as though I have just “accept” this from ParcelCompare.
