    So update on this, I have now received a notice to keeper. 

    With some further investigation I have found that there are signage for 2 parking firms. The area where the vehicle was parked in is covered by a parking firm which confirmed they no longer enforce in that area. The second parking firm decided to place a PCN on the vehicle despite the signage being for a complete different firm. Note the sections are very close together. 

    Please see attached the letter to keeper. 

    I will appeal using the template and have added the section at the end. Is this okay?



    Re PCN number: 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    The signage in the area the alleged contravention takes place is covered by a different parking firm. You must also confirm that you are contracted to cover the area and prove your signage covers that area.

    Yep that's OK.

    That is a 'POFA worded' NTK but you've covered up all the dates, so we can't say if it's compliant.

  • Apologies, I think it is compliant as it's within 56 days but notice serve date is 1.3.24 and pcn was placed on vehicle on 30.1.24.

    Good morning. 

    I receive a letter before claim for this matter and responded to it using the templates provided. 

    They have now responded to me and the only part of note is:

    Thank you for your email. Please note, the £70.00 is a late payment surcharge as the PCN was not paid on time it is not net or inclusive of VAT.  

    From my reading of threads I am unclear how to respond to this. Do I report them to HMRC? 

    I can post the full email response just cautious that it may make it easier to identify me.

    Yes report the LBC sender (which solicitor?) to HMRC now.

    Tell HMRC that they are charging a blatant debt recovery fee - calling it a 'late payment surcharge' - but it certainly is not part of the PCN.  Yet they are suggesting that VAT does not apply to this extra £70 admin fee.

    have not really see many park direct court claims (if any)
