Deferred migration - notice issued in error?

Options
Hello, its my understanding that anyone receiving CTC for a child who's 19 & in full-time non-advanced education should have their migration deferred until the child turns 20.

Page 10 of Case Manager's Guidance here: [forum won't let me post links.]

Per Regulation s.44 5(A) & (C) of UC (TP) Regulations here:
[Forum won't let me post links].

You should be able to request a migration notice be cancelled forthe reasons in those Regulations.

I received a migration notice the other day. I get WTC & CTC & have a child who's 19 & in full-time non-advanced education.

I rung the number to speak with a migration advisor & they are insisting I sign up for UC in order to get the notice cancelled. This doesn't make sense. If I sign up for UC, my WTC & CTC claim will be cancelled.

See below, they managed to get the migration notice cancelled:

[Forum won't allow links.]

Surely, the answer is not to initiate a UC claim to cancel the migration notice.

They didn't have a postal address or any way else to contact anyone about besides initiating a UC claim. Any advice?

You need to ring the special helpine number that is listed on your migration letter. It tells you exactly what to do.
If you don't make a claim or contact them to defer, as per your migration letter, your tax credits will simply close.

Its not been sent it error, the system doesn't have the insight to know you've a 19 yr old.

Theres been a couple of threads about this, some seem to call the helpline and its sorted, sadly some seem to get someone who has no clue and its a battle.  I hope your not going to experience the later.

    Good luck.,,,

Yes, the chap on the phone seemed to have no clue. 😬 He said he couldn't take birth date details over the phone (cited GDPR). Said I need to sign up to UC to get deferred but, that makes no sense.

You do not sign up to UC to get a migration notice deferred. If you sign up to UC then your Tax Credits will end.

I've been through this. My experience of the UC helpline was not positive. Others have been more fortunate I believe. I had to get my MP involved but he got it sorted out within a week. Here's the thread I started about it:

Thanks for that! Very helpful. Looks like it might be one of these things where you should hang up & ring again & see if you get someone else who maybe knows what they're talking about. Pretty shabby service from DWP. My fault probably for ringing on a Friday, could barely hear the chap on the phone for all the giggling, laughing & loud chit chat in the background in that office. I told him 3 times it doesn't make sense to sign up to UC to get it deferred. He just repeats the same thing over & over again. I'll ring again & if I still don't get any sense out of them, MP it is I guess. Shocking. Thanks.

call them they will cancel it

Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

Are you ringing the UC helpline or the UC migration helpline?
    UC Helpline is 0800 328 5644 won't help.
UC Migration helpline is 0800 169 0328 should be able to help.

  • I've rung back & got a decent agent this time. After a bit of discussion he needed to consult with his manager & was to ring me back. He did so half an hour later & said right enough, its meant to be deferred & said they will cancel the notice & I should get a letter here soon.
