It's self explanatory because it's not asking for 'driver' details is it? Perfectly safe for the keeper (the person named on the PCN) to appeal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi folks just wanted to say thanks to this thread (I luckily stumbled across) after I was fined for not paying the airport drop off charge at Gatwick, I read through the newbies info and followed all the advise on here with regards to appealing to MET and it worked! I got the "on this occasion we have cancelled the charge" email.

My turn to say thanks.
Appealed and received the reply a couple of days ago...Your appeal has been reviewed and has been considered in conjunction with the evidence gathered at the time of the contravention. Having considered the content of your letter this notice has been cancelled and no further action is required.
Woukd just say Para 3 of the appeal template says APCOA, maybe this should also have (APCOA for Heathrow or NCP if it is Gatwick) or similar.

I am the registered keeper. APCOA cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Heathrow Airport is not 'relevant land'.
If Heathrow Airport wanted to hold owners or keepers liable under Airport Byelaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a byelaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.
The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NTK can only hold the driver liable. APCOA have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

I can happily confirm that my Heathrow drop off penalty charge (September 2024) was waived after I sent a challenge using the exact wording from Troublemaker22 at the top of this thread - thank you !4
