Hello all. Just recieved one for Heathrow. Here is the thing, I didn't actually stop, I belive I just drove through as I was looking for someone whose phone was off, so I do not think I stopped. I then went into the short stay parking and paid for the duration of my stay, as I ended up going to actually look for ghs relative in the airport and paid for the duration I stayed, and I have it on my credit card.

In this case, do I use the same guidance above, as the car belongs to my daughter, but I'm a named driver and should I also include the fact that I just went past the drop off and ended up going into the short stay where I paid?
Of course you can't put that! Think about it...

Anyway your daughter appeals, not you.
Just an update to my case the Silly Billy's have cancelled my ticket! I'm really grateful for all your help. I was so !!!!!!, as just driving through and then the ticket, didn't even stop. . It's almost like we're not allowed to drive through the airport. If anyone wants to see the cancellation letter, let me know and can copy some info without actual name and details, for obvious reasons. But many thanks.

Point 5 regarding the grace period, may no longer be valid:

Section 5.2 "The grace period does not apply to short stay areas – controlled land where the parking of a vehicle is permissible for a limited period not greater than 30 minutes, for example at airport and railway station drop off and pick up zones.
It really doesn't matter. Any appeal as the Keeper only and the PCN will be cancelled. No need to overthink this.

And that isn't even a change to the Code.

It always said that but who cares about what the BPA & IPC say in their cloud cuckoo land.

  • Had a drop off PCN though the door from Heathrow, having had a delayed late night flight and a busy weekend I simply forgot to pay it.

I've never had a parking charge before so unsure what to expect, and just want to check the template on the first page is still relevant and up to date?

The wording of my fine states this: "As we do not know the name of the driver or their current serviceable address, we request that you wither pay the full amount or make and appeal, you cannot do both. If you were not the driver of the vehicle please provide us with the name of the driver and their current serviceable address."

I just wanted to check that this is the same usual wording that everyone recieves for the fine and there's no legal obligation to provide the drivers details.

Thank you for your help on this page, fingers crossed I can get it cancelled and come back with some good news 😅🤞

Yes it's all normal follow appeal advice don't go admitting being the driver.

Why is everyone overthinking this. When the NtK arrives, the keeper appeals with the following wording (verbatim), nothing else:

I am the registered keeper. APCOA cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Heathrow Airport is not 'relevant land'.

If Heathrow Airport wanted to hold owners or keepers liable under Airport Bylaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a bylaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NTK can only hold the driver liable. APCOA have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

No need to remove or embellish it with useless drivel or circumstances. Just appeal with the above by the RK and that will be the end of it!

So is this the correct response? I see lots of different replies on here and I’m easily confused (hence not realising I needed to pay the charge within 48hours and so have paid it “late”)

I went to t4, in husbands car, was there 10 mins max and my husband has received a pcn by. APCOA. Help ?

Yep. Not you. Your husband puts in that appeal online to APCOA.

    He ticks registered keeper.

    He wins.

    100% guaranteed, honestly. Trust us.

  • In mid November I received a postal PCN from APCOA concerning a Heathrow T5 drop off charge which the driver had forgotten to pay.
I appealed as the Registered Keeper on the grounds advised in this thread and the expected cancellation came through today.

“Thank you for your letter received on 16 November 2024 regarding the above Parking Charge Notice (PCN).
In your appeal you have explained that you are the registered keeper of the vehicle and declined the invitation to provide us
with the full name and address of the driver.
On this occasion we are prepared to exercise our discretion and have now cancelled this Parking Charge but must inform
you that the terms and conditions in this location advise the driver that they must pay for each visit to the site. Signage is
displayed at the approach to this drop off area, along the location and upon exit, advising all motorists that a payment to use
the drop off area is required to be made online or by phone. As stated above, the terms and conditions of using the drop-off
zones are displayed by way of clear signage. It is the responsibility of the motorist to read and comply with the signage on
    site.
Please retain this letter as proof of cancellation, should you need it in the future.
    Yours sincerely,
APCOA Customer Support Centre, APCOA Parking (UK) Ltd acting on behalf of Heathrow Airport Limited”

A big thanks to all those on this forum who contribute to such an excellent resource.

Easy when you know how! Never fails.

Nicely done, both of you.   :)
