( friends) Christmas day fine by car park sercurities

Hi guys, friends recently had a fine with the above company citing they tried to pay online for a duration but having tried they unfortunately couldn't get connected and whilst they were out enjoying Christmas day they were unable to pay due to the network being down.

A letter has been sent with no names ( just the keeper route ) and they have stated that this said registration no has tried to make an attempt to pay however was unable too.

Later it was found that other council ran CPs enjoyed a free day , it was Christmas day after all ! ...but not for CP Securities....they have taken on board the first acknowledgement letter and have snubbed everything that was mentioned. 
They want their money 💰!! And they have even said rather gracefully that you can appeal to the IAS but I'm not so confident it will achieve anything positive,  they also don't seem to be a member of BPA either. 

Are these another new company that are trying it on? 

I'll post the full wording in the reply letter if it helps ?

  • They certainly are members of the great Gladstones/IPC/IAS scam

    The IAS IS A SCAM, more than 90% appeals fail.

    With the new government code of practice comes with an independent appeals service which means the IAS will go in the rubbish bin where it belongs

    It's free to appeal to the IAS ON THEIR STANDARD APPEAL.
    Don't expect much from this scam bunch .... it make no difference, it is a court judge who makes a decision and they know all about the IAS and the parking scammers

    And of course you do not pay CPS or even contact them

    If it actually is a Council run car park, you might find it a good idea: -
    Since we concentrate on parking charge notices from unregulated private parking companies, you would be better off taking this over to our friends on Pepipoo.com as they are the experts on council and police issues.
    You will need to sign up on Pepipoo with a non-Hotmail email address before reading the FAQs, then posting both sides of your PCN with your query.

    If it is private, continue on this thread by all means.  Did you/your friend try the landowner/retail outlet/pub for a cancellation? - Plan A in the NEWBIE sticky.

    We are trying to find out who the land owner is, nothing seems to be on the register.
    It's a car park that isn't Council owned and has these guys monitoring it with ANPR cams, you can pay online or machine - there is also a string of reviews that claim payment wasn't possible at the machine , like in my friend's case, like I said they have replied with the obligatory first letter, but from now on silence, I've made them aware ( I'm helping 😉) that the Council car parks were free Christmas day, and that an attempt was made to pay, now they want something like 80.00 citing it's a fine! - we no its not ! 
    Will post more in due course .

    I've made them aware ( I'm helping 😉) that the Council car parks were free Christmas day.
    That point is totally irrelevant to a private parking charge.
    ........now they want something like 80.00 citing it's a fine! 
    I would bet you they did not say that, but if they did report them to your MP, Trading Standards and for what it's worth the IPC that is a lie,misrepresentation of authority, against their ATA's COP and sanctionable.

    If it's a private parking firm, praying in aid what the council did, or didn't do on Christmas Day is irrelevant, and futile. 

    Let us see the first letter they've sent, redacting any personal details, any VRM details, front and back. Please leave all dates showing.

    This is the same as when people tell us they used a car park after 8pm or on a Sunday when pretty much every run of single yellows are free and so are most bays. My jaw always hits the floor when I read that, as I wonder: why seek out a car park?

    My point is: always look to park on-street, as any driver's plan A.  I'd be willing to bet there must have been streets where no restrictions applied. I never use a car park unless shopping there (retail park or supermarket), or visiting a hospital in a city on a weekday with zero street parking.  Please encourage your friend to avoid private car parks completely.

    The private parking sector is looking to take every opportunity to claw money from motorists. Even more avaricious than local authorities. They are tightening every screw they can lay their hands on. The trap your friends have just fallen into - parking in a car park on Christmas Day when almost all businesses are closed, and ergo (in the eyes of the private parking sector) no parking is legitimate - PCN en route, regardless of the season of goodwill. 

    Be suspicious of any private car park. Treat them all as cautiously as one would when thinking about a swim in a sea where known sharks swim too! 🦈

    I realise that; a lot of people I know wrongly used to do the same, until I stopped them driving past free bays on street and seeking out a stupid idea of an ANPR car park that risks £100 per day!

    Please give your friends our advice above.

    No-one should be looking for a private car park on Christmas Day, evenings or weekends. It's not 'safe'.  The street is.

    We will help them/you.

    They won't be paying this PCN but avoid car parks like the plague in future.

    I've had a Christmas lunch at a town-centre restaurant on Christmas Day; the town centre car park was the most convenient place to park.
