Snagging issues in a new house

I recently purchased a new house. It wasn't cheap. The first week I was here I woke up one morning to find that the utility room and kitchen were flooded following an ingress of water after heavy rain. I have now been in the house 3 months and have experienced at least 3 major floods and 7 minor ones - all after heavy rain. It has since become apparent that the water ingress had occurred on a number of occasions during the latter stages of the build. In other words the developer was aware of the issues prior to exchange of contracts. Obviously I didn't know about the issue at exchange as the developer didn't tell me. Was there a legal obligation for the developer to tell me before exchange? If so what recourse do I have?

    Are you saying the house was fully built before you exchanged contracts? Did you get it surveyed?

    I would not call this a snagging issue, it is a major fault. Presume the house is still under warranty?

    You need to follow the procedure in the NHBC handbook which gives the developer the opportunity to rectify the problem in a given timeframe.

    If they refuse or do not fix the problem then you can pursue it through a claim with the NHBC (or other warranty provider depending who they have used)

    The developers are under no obligation to give you details of any faults found during construction of the property.
