BaySentry Solution Parking Ticket- return within no return period

On 19/11/2023, I utilized a parking facility provided by BaySentry while shopping for my children. Shortly after entering the store, one of my kids, who experiences lower urinary dysfunction and lacks the ability to control their bladder, urgently needed to use the restroom. Unfortunately, the store attendants informed us that there was no customer toilet available. Given that our home was approximately 10 minutes away, we returned to the car so my child could use the restroom at home. Afterward, we returned to the store to complete our shopping.

On 02/12/23, I again shopped for groceries at the same complex and utilized the same parking lot. However, halfway home, I realized my bank card was missing. Returning to the store and parking in the same lot, I inquired with the store attendants about my missing card, but they indicated that no one had turned it in. It was during this interaction that I first became aware of the parking lot's no-return policy, as I had previously believed it was limited to a one-hour maximum stay (as indicated in bold).

Recalling the incident on 19/11/2023 when my son urgently needed to use the restroom, I contacted BaySentry customer service to explain the situation. Due to it being a weekend, I received no response. Subsequent attempts on the following Monday advised me to wait for the ticket and contest it with the appropriate evidence.

To my surprise, on 12/01/2024, I received a notice of debt recovery from DCBL, the direct collections bailiffs, for the parking incident on 19/11/2023. This caught me off guard, as I had moved to a new address and updated my information with the DVLA a few days after the shopping trip. I was informed that the process could take up to 12 weeks to complete.

Despite multiple attempts to contact BaySentry, they have not responded, and the debt collection agency has provided no assistance. With a deadline of 19/01/24 to pay, I am facing the possibility of court action. Financially strained, working full time as a single mother to two children with disabilities, I am unable to afford the payment. Any advice you can provide would be greatly appreciated.

    Parking firms don't have one.  Not for motorists anyway.  What made you think they have that ethic?

    They didn't get your new address from the DVLA.  They did an address trace.

    You were surprised?  This is what this aggressive industry do and you are lucky that they traced you and didn't just keep using the old address, and cause you a CCJ this year, behind your back.

    Why didn't you give Bay Sentry your new address? They can't ask the DVLA twice and addresses are mainly up to you to keep up to date in cases like this where a CCJ to an old address would be disastrous.

    No such deadline. If this is just a letter from DCB Ltd demanding a ludicrous £170 you obviously completely ignore it, as seen when you searched the forum...

    ... except for ONE RESPONSE telling them and Bay Sentry to erase the old address.

    That needs an email to both companies' DPO (Google it please, if that acronym is unfamiliar) and use that word 'ERASE'.

  • BaySentry don’t earn any money by accepting any valid reasons for allegedly breaking their terms and conditions which are designed to extort money from motorist.

    If I were you I would first read the Newbies thread and secondly go back to the store with both PCNs and complain in the strongest terms to the most senior manager present. This may well result in a cancellation.

    So you take copies of those with you.

    If landowner complaint doesn't work, let them sue because these are easy to defend.
