Wow. I received a PSPO fine for driving a standard car past a noise camera! No right to appeal too!

Hi guys,

So I received this in the post, it is a FPN for passing a noise camera too loudly.

The noise camera was set up in this area as there is regularly a car meet here during the day on weekends. At the time in question, the car was travelling alone past the camera at 11pm on a weekday. It wasn’t being driven excessively aggressively, being revved or speeding up repeatedly like it suggests. I would 100% appeal this but it says you have to wait for a court summons to do that and then the fine can be much more.

My issues are:

Do they not have to prove who the driver was, as this is technically a criminal offence from my limited understanding?
Would they also not have to prove the part about “revving” and “repeated sudden acceleration" as well as "as to cause a public nuisance"? Is that possible by just having a video camera with a decibel meter attached?

I understand what these cameras were set up for. I've seen people parked up on Sloane Street revving with pops and bangs maps and modified exhausts. That's not what happened here or what they were set up for, the car was literally driving past it, and it is a standard car with a non-modified factory fitted exhaust.

Has anyone got any experience with these? Are they enforceable if taken to court, or do I have a good chance of beating it? If slim chances I'll just pay it.

Thanks for your help!

We don't know how loud your car is/was, I would guess it's not a standard car?

No but it is a standard car, that's why it's even more annoying! No modification, no aftermarket exhaust, bog standard factory car

Oh unless you meant what type of car it is? It's a Porsche, so yes it's a sports car but its still factory spec and not a V12 Lamborghini

So it is still quite possibly obnoxiously loud, just not deafeningly obnoxiously loud.

Quite possibly, but no warning signs that there are noise cameras in the area so owners of "obnoxious" cars can stay away seems a little unfair

There is no need for warning signs, if the volume exceeds the level deemed a public nuisance then a fine can be levied, I only wish more councils and police forces would do more to tackle those who undertake antisocial behaviour using their cars engines.

  • Is a photo enough to prove noise / speeding up repeatedly? I would presume they have video with sound too if they are confident It could be taken to court. Does say on there you can phone them up to discuss the penalty though.
