If that answers your points, fine.

I suspect that you asked for a copy of the original agreement, and proof that they have been assigned this debt. Maybe others

Obviously they haven't provided that. You could remind them about what they haven't done

They are very aggressive. How much could you offer as a lump sum? You would need to be careful about doing so -so don't rush.

If a claim form did arrive you have to do something within 14 days. And the usual first step is to acknowledge service and get another 14 days

    Hi fatbelly,

thanks for your reply. They are very aggressive indeed, they text and call almost everyday. I did ask for all documents that were listed on there, so I guess I could reply to the email asking them for the copy of the original agreement and also proof of assignment? Would they send this over on an email or via post?

There’s not much I could do in terms of offering a lump sum.. potentially £1000 at the end of the month. Where do people normally start with offering lump sums? 25%?

well, nothing has arrived as of yet but judging by how they have been, I assume they’ll be wanting to push this through quickly. For now I’ll email them back asking for a full copy of the original agreement and the proof also. Would this be fair to do at this point?

    Well they haven't provided those.

It doesn't stop them from making a court claim but the first part of your defence would be that they haven't provided the evidence you asked for.

No problem - should I go ahead and contact them asking for those documents again?

I certainly would, because if they are unable to provide them, you may find they drop the whole thing like a hot stone, I`m not saying that will be a definite, but a distinct possibility.

They can be as bolchy as they like whilst things are going their way, but throw a spanner in the works, and they often back down pretty quickly.

Yes. Until we actually see them throwing money at this by way of a court claim it's just the usual harassment.

Just received the below - seem to be very aggressive with this indeed.

Now that I have finished work I will reply as intended as discussed earlier and see what they say.

    Something along the lines of

I believe my response to your letter before claim was satisfactory. However yours was not. I asked you to evidence your position by supplying several itemised documents. To date I have received none of these.

Please do not ignore this email.

All legal action achieves is they get the court to agree you owe the money, and you repay it at an affordable monthly rate, if a CCJ won`t affect your work/job etc, it really is nothing to worry about.

Emails like the above, seem to imply its the end of the world if you don`t respond, when it really isn`t.

Its quite laughable what they think will intimidate you.
