Ocean parking > Popla advice?

Hi a friend of mine parked on what he thought was free parking and within 5 minutes of driving in and out of a car park he received a letter from Ocean Parking with a BPA logo.

I’m im going to tell him to send the one size fits all template on 26th day, but I’m assuming they will come back rejected and have to go to Popla.

if this goes to the Popla stage what sort of template can he use to appeal this? I’ve searched on the forum but can’t really find anything. The ones I saw have “link removed” in them or don’t really apply to a car park.

    That must be some sort of record - receiving a letter within five minutes of leaving the car park.   ;)

    Please be a little more concise with your information. What you have posted does not make sense.

    What precisely has your friend received? If they have received a NTK, we need to see it with personal data redacted, but dates, alleged contravention, and location showing.

    Are they not capable of following the advice in the sticky Announcement for NEWBIES?

    Plan A is always a complaint from the keeper to the landowner and the keeper's MP. Have they done this yet?

    Where did the alleged event occur? It may have cropped up here before.

    I will attach a photo.

    The car park has a camera that videos when you enter and exit hence the fine for a short amount of time.
    He was in the wrong but it’s still unfair.

    it was in the Peel Centre in Stockport.

    I read the newbies but couldn’t find a template to match this event…

    I have some recent experience with Ocean Parking whereby the notice to keeper was not compliant with the Protection of Freedoms Act 2012. If that is the case here (we need to see the letter) then, as I remember it, there's advice in this forum that mentions something like a "golden ticket" that can be followed. In simple terms, if the notice to keeper is not compliant, there is no legal basis for Ocean Parking to go after the keeper, rather than the driver, in relation to an unpaid parking charge so, whilst any appeal to Ocean Parking is going to be rejected (they may claim that the use of ANPR means they don't have to send the NTK under PoFA2012, but that's nonsense), you should get a POPLA reference where you can reiterate the non-compliance and they should take notice of it.

    That's a reminder, and you have left your name and the PCN number showing. We need to se a redacted copy of the original NTK, both sides, but you should delete the post first.

    I have reported it accordingly.

    We don't need to see the NTK as we already have both types of Ocean NTK here and the OP can see if it exactly matches the wording of the POFA version or the 'non-POFA' one:
