  • Hello again. 
    I have a question.

    So Ive got nearly all of the defaults now and a couple of letters from debt collection companies.

    My question is, should I now deal with/send everything to the debt collection companies? I was thinking of sending them my original letters (That I sent to the banks) and my latest SOA. 
    Any advice would be greatly appreciated.

    Debt collectors have no say over anything, they are engaged to collect your debt, nothing more.

    Send write off letters to the banks that own the debts.

    Sending all that paperwork to a debt collector will see them return the account to their client post haste.

    So a debt collection company works for the creditor. If the debt gets sold off, then that's a different thing?

    Whoever owns the debt can sell it on to anyone else. The current owner can collect it themselves or get someone else to collect it for them.

    Hi again sourcrates.
    Ok Ill send write off letters to all of the banks.
    They have all asked me for more information ie doctors letters etc but none of them have given any kind of answer to my SOA at all.
    And now they are starting to pass me on to Moorcroft to deal with it for them.
    I am unsure if I should tell Moorcroft that I have no money and that I intend to pay £1 per month etc etc. Should I make contact with them at all? If the bank ignore me and only Moorcroft are contacting me Im not sure what to do. 
    Someone said that I should not make contact as legally it might be a bad idea to have any contact with them at all.

  • Also another thing is (if anyone can answer please) The bank are asking me to send in doctors letters as the reason the debt started in the beginning was due to my partners close to death illness and I am now having heart problems. Are they allowed to ask for these? I stupidly said that I could send in proof when I sent them my original letter explaining my whole story. Should I tell them that I have changed my mind as its private or should I gather letters from my doctor and send them to them?

    If you are asking for a write off on health grounds then you need to supply evidence from your doctor of hospital appointments about those problems.
  • You absolutely can keep your van if you enter a DMP -the whole point of a DMP is that you make the rules, you are in charge.  what gets marked on your file are the defaults - and it is those defaults which will mean your access to credit is restricted for 6 years or so. As already said though, that's not such a bad thing. 

    The steps we usually suggest where a DMP is the right thing is:
    - put together an SOA which will also begin to help you build a proper monthly budget to live by and ensure that you are budgeting the right amount for all your priority bills
    - stop paying all unsecured debts and allow those to default
    - while no payments are being made (waiting for the defaults) use the money saved to save for an emergency fund and hopefully a bit of a "fighting fund" too which might enable Full & Final settlements in the future
    - once the defaults have arrived confirm the the creditors the amount you are currently able to pay them, and start making payments.

    That's very paraphrased - it's all set out more fully in the "First steps" sticky/announcement post at the top of the board.

    Im still waiting for defaults and do have a few but not all and now Im getting worried because Im getting letters from debt collecting companies and Im worried about how long it will be before they turn up where I live. Im at a shared address.
    Im not sure how to go about offering the token payments once I get the defaults as someone suggested I set up a standing order but if my accounts are closed how do they know who its from? 
    Anyway, Im hoping the sticky might help. Ive looked but I can't see it anywhere.

    If your intention is to obtain debt write offs, then the banks are not going to do that just on your say so.

    You ask if they are allowed to ask for such information, well yes, anyone can ask for anything, you have the right of refusal, but if they have asked for evidence to back up your request, then it makes sense to supply whatever you can in order to obtain a positive outcome.

    The likes of Moorcroft are not interested in, nor are they a part of this process, there sole purpose is to collect your debt, nothing more.

    You need to be engaging with the original creditors and be as open and honest with them as possible in order to get what you want.

    Ok I understand. Im not really asking on health grounds but explaining that my situation is leading to ill health. I just don't have the money and probably will never have it. My partners ill health is what started all of this. I could send proof it that I guess.
