    Sorry, it's been a while but, thank you for all your help on this.  Since sending the last letter, as advised above, I haven't heard anything back from BW Legal over the past 15 weeks or so.  For the record, the following is the letter verbatim (apart from redacted personal data)...

    To BW Legal

    Further to my previous correspondence,

    I am the registered keeper of the vehicle. I am not obliged to identify the driver and I decline to do so. As there is no legal presumption that the keeper of a vehicle was its driver on any particular occasion, your client cannot pursue me as driver (see VCS v Edward, 2023).

    As you and your client are well aware, there is no keeper liability at Gatwick Airport because the airport is not ‘relevant land’ as defined in Schedule 4 to the Protection of Freedoms Act 2012. So your client cannot pursue me as keeper.

    As your client cannot pursue me as driver or keeper, it would be an abuse of the court’s process for your client to issue a claim against me and I will defend any such claim vigorously and seek costs in relation to your client’s unreasonable conduct.

    Incidentally, do you know how long they have from the day of the alleged contravention to still pursue this debacle? 
    ie, could I expect another letter in years from now?

    Its 6 years from the incident date to start legal action in England and Wales 
  • Hello and thank you for this forum! It’s such a huge help. Just a couple of weeks ago I got a letter of claim from dcblegal who are representing vehicle control services Ltd. In July tried to pay online for parking but the network was wack, I then tried by phone but they were asking such intrusive questions so I decided to pay at the machine. I stood behind 4 or 5 people and finally payed to park. I got back even before my ticket ran out only to receive a PCN from them, for failure to purchase parking tariff on site or within time allocated. The time elapsed was 12 or 14 mins. 

    I think they are IPC registered. 

    We have now got to £170 with a letter of claim.

     I now have one or 2 weeks to my 30 days elapsing. 
    So I plan to send the letter you have shared on this forum for letter of claim. Hope I am correct so far and have not missed anything?

    Hi, we just received a notice for an airport stop (reading sign at a barrier for 35 seconds according to their pics). I had parking pre paid just went to the wrong bit due to Google maps, ended up going through the wrong barrier and paying £7 to get out before going to the right barrier. 

    I only just got the first letter. You can’t tell who is driving in the pictures. Should I wait til a legal form send me a letter or do the original appeal through myparkingcharge.co.uk or try get in touch with VCS directly telling them about the registered keeper stuff? Any template and guidance would be appreciated
