LBCCC from parkingeye

Hi all,

I received a PCN in October from Parkingeye, but I was parked at a resident parking space, who is a friend that I am visiting.
I followed the newbies thread, emailed enforcement@parkingeye.co.uk explaining the situation, and also cc'ed the management. My friend has also emailed the management seperately and appealed to parking eye with the lease.
Parkingeye has replied saying they are going to proceed.
The complication to this is that we are moving before/on the day of deadline day for reply.
At this stage should we reply using the reply form PRE-ACTION PROTOCOL FOR DEBT CLAIMS?

    Do not fill out any forms.

    If you need more time, send a hold instruction to the DPO of PE stating that whilst you deny the debt, you are seeking debt advice and require the case to be put on hold for 30 days as per court pre-action protocol. Do this a few days/one week before you move.
    You must also send a rectification notice to the DPO of PE as soon as you have moved, instructing them to erase your old data and replace it with your current (new) address for service.

    Do this by email and send it to yourself as well. Ideally, set up a throwaway email address purely for dealing with the PCN.

    You will need to include non photo proof of ID with each instruction.

    You should complain to your MP if you haven't already. You should also complain again to the landowner and managing agent, asking them to provide details of their legal representatives and the contact details of the person(s) who will be attending court as witnesses.

    Is there not one for DPO@...? If in doubt, send it to as many as possible, but the privacy page should have the DPO email address on it somewhere.

    If you are moving abroad then it will help you greatly since you will be outside the UK court jurisdiction. It is imperative therefore that you delay the claim itself by sending the 30 day hold instruction just before you move.
    Once you are abroad, then send the rectification notice to the DPO instructing them to erase your old data and replace it with your "current address for service". Include proof of overseas residency with your proof of ID.  

    Make sure you use the word I have highlighted as it has a specific meaning with regards to data handling.

    Have you yet sent PE the reply that asks for a 30 day hold due to seeking debt advice?

    If not, I would send that by email now to the enforcement@ email and tell them that the postal address used in 2023 will no longer be valid for service in 2024 as you are permanently moving this month and will confirm the address once known.

    Don't mention it is abroad.  Not yet.

    THEN email them again with the apartment address abroad, near the end of the 30 days.

    You are going to have your mail forwarded to a relative's address for 6 months, yes? Vital.  Well worth the Royal Mail fee.

  • Thanks Coupon-mad, I have emailed enforcement@email today and reference the newbie thread:
    The alleged debt is disputed and any court proceedings will be vigorously defended.
    I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').
    I also mention that the postal address used in 2023 will no longer be valid for service in 2024 as I will be permanently moving this month and will confirm the address once known.
    I also email and forwarded the pricvacy@email of the above, sending a rectification notice for them to erase my old data and update with my address once known.

    Thank you for your advice, anything else I should do for the meanwhile?
